Latest update on the OTA issue. I contacted AT&T tech support twice for about an hour each time. The first call after doing another soft reset, resting the network and sending an activation signal (which screwed up my VM) the tech decided to send me a sim card. To their credit they did overnight it to me.
Still no joy and the error popped up at startup. I called tech support again and after being on hold for twenty min's the tech says I need to speak to a tier 2 tech support but they are closed, this was 700pm. So now I'm going to have to take time from work to sit on hold and call AT&T again
