maybe try flashing/hacking your phone? just been over to xda-developers (i'm assuming that I can mention this on this forum) and there seems to be talk about a fix for this Volume Hack - xda-developers).

means nothing to me at the moment as still awaiting my N1 but may be worth investigating further.
