For anyone who's found that there are apps no longer available in the marketplace after the upgrade here is what I received from a developer:

You can pass along that applications in the market that are compatible with your phone and have the "Copy Protection" flag set by the developer in the market are not able to be seen on the market or downloaded by your phone. Our hypothesis is that the patch caused the phones to be seen as compromised/restricted and they should contact Google Marketplace to get it updated to legitimize the patch or otherwise resolve the issue with them.
In my instance they were prepared to remove the copy protection flag and I could re-install the app. You'll either have to contact the developer for them to do likewise or wait for Rogers to address the problem.
