No. I don't feel it is unethical. Dumb, but not unethical.

Dude with the messed up phone. Assuming you have the insurance from Sprint. Drop that thing in the river, and tell them you lost it. (Take your memory card out).

EDIT: Don't drop it in the river... Pull the battery, and throw it in a drawer...
