I can only presume Apple doesn't see HTC as a threat.

BTW from what I read on engadget Apple have dropped the design patent case : Apple and Samsung finally agree... to drop a plethora of claims from their patent spat -- Engadget
Patent litigation is insanely expensive. Plus, once you've successfully tested a patent in court, it is easier to get everyone else to settle. Usually the litigant will sue a first company and if successful they will then threaten to everyone else to settle. The long winded point is that HTC could very well just be next.
