Default [possible proximity sensor issue] phone is silent when in pocket

I have recently got my hands on a HTC One. I love it so far but I have a problem. When the handset is in my pocket it does not ring when receiving an incoming call, it just vibrates. It rings fine when it's out in the open.

I believe this is a feature you can set up on some phones. But it is not something you can select or deselect in the sound profiles on my phone. I've tried it in pocket mode, with different ringtones, from different callers, with vibrate turned off. But nothing has cured this.

Any ideas before I head back to the shop?
