AAgghhhh cannot upgrade the rom!
Just checked the acer mobile site for the uk and although its not the 2.1 rom, there is a rom that does fix the crap battery usage! but i can't download and run as you have to use the windows update tool - i run Linux 
Just asked them to supply the actual rom instead so i can just upgrade it via the recovery console and upgrade from the phone's SD card
