If Google Latitude isn't going to work for you, many carriers offer that feature as an add on. AT&T will let you (for a fee) track up to 5 phones on a family plan with a service they call FamilyMap. Check with your carrier to see if they offer something like that. Of course you will have to be the primary account holder and have the permission of the person you are tracking.

Not universally. It would depend if the child had an independent account, was of age (or a certain age), etc. And, this could vary by jurisdiction. If uncertain, it's always prudent to check with local authorities.
