Default Sprint Class Action Lawsuit??

Hi All,

My wife is an attorney and I'm trying to convince her to move forward against Sprint for blatant lies and am trying to figure out how to get solid proof of these things as well as looking for other people who might have the same issue. We're already dealing with them about another issue and it caused me to start digging more and more into the company and I'm shocked at the lies I'm finding.

So, the class action would revolve around them suppressing the 1X symbol on some of their phones (Evo 3D for instance). I rooted my phone and started seeing the 1x symbol a lot where I used to see 3G symbol. After digging around other forums I see that others are making the claim that Sprint purposely is suppressing the 1x symbol so you see 3G even when it's not in fact 3G.

1. Is this in fact true?

2. How can I prove this?

3. How many phones are known to be affected?

4. Any other opinions?

Personally taking action against a large corporation is very difficult, unless you too, are in fact a large corporation, a lot of times you will just incur a lot of Lawyer fees and be in a legal battle for decades...

Yes I do know this being married to an attorney. One good thing we have is a lot of connections to other attorneys who might be willing to help if they see 100% that Sprint is lying to their customers in such a blatant way. My hope is that we can get a few people my wife know to help, understanding that their fees will depend on the result of the lawsuit.

Again, I do understand it's a long shot, at this point I'm just investigating the truth to the claims and trying to find out how widespread the issue is

I mean i am not against your claims at all. I was just saying the outlook doesn't look too optimistic, but good luck though.

I believe that it is in your contract that you can't bring a class-action against them. Most of the carriers have language in their contracts that it is illegal and you are required to use arbitration on a case by case basis if you were to bring a legal suit.

Yeah that makes sense (although the idea that arbitration paid by the defendant can be unbiased is a joke). Looking forward to when SCOTUS takes down those clauses in contracts. Microsoft has same crap in their contract.

Well still looking for advice on if the claims are true

Very interesting, so Sprint just has the slowest 3G in the nation.....sweet. I live in San Diego and rarely get speeds that make me even think "that was okay speed", went to Las Vegas this weekend and got no reception AT ALL for about 95% of my trip....well back to my other issue with them (changed my plan without permission, admit fault but say there is nothing they can do.....)

Yeah all of us Forum junkies know when a stance is supported by the forum or not Just sick and tired of being taken advantage of, right now I'm hovering around 30 kbps.....ridiculous

Sprint may have the slowest 3G in your area, and like all carriers has areas of limited or no coverage.

Here's what I get on 3G -

Sprint is engaged in a complete network overhaul and expansion, you can find details in our Sprint/4G forum - they're calling the buildout Network Vision.

Emailing them and specifically requesting Tier 3 service might be helpful for you.

Trust me already talked to tier 3 service at least 3 times plus managers and supervisors, almost all of whom openly admit that there was a mistake on their part but they have absolutely no clue how to fix it. Been going on almost a month now, already pushing forward with BBB and wife is getting paperwork together for a lawsuit against them.

To Summarize the Issue:
In-Laws on expired plan had 5 phones on it, father in law wanted another line, Sprint said couldn't because they are maxed out on lines on the plan, I called in and asked at least 5 times if I took my wife onto my plan (moving from Ind. to Family) if that would allow my father in law to get on the family plan, they repetitively said yes, went forward with change verifying yet again that I would be able to do what I wanted, they again said yes, change happened, father in law went in for new line and they said because it was an expired plan they couldn't do any additional lines. Result, my plan went up $65/month, my in laws dropped $9.999, so we're out $55/month for no reason.....

Dan is the CEO and his office doesn't take kindly to customer runarounds. No guarantees, mind you, but several people hereabouts have reported satisfactory results emailing him. I've emailed him myself protesting their anti-root TEP policy and I don't think that it was just me, but they changed that policy.

Last I heard, his email was Daniel.R.Hesse@sprint.com - avoid the infamous dan@sprint, it's an auto-responder.

Going to add that to my list and try that way also. The last guy I spoke with refused to give me his extension for me to call him back, his response to my request was "look you can call back and talk to anyone, I put in notes", where I responded "but you know the story and it took me half an hour to explain it", his response "yes, but just call the generic line and talk to someone else"....I mean just terrible customer service

Couldn't agree more.

Tier 3 service always you a tracking number and full contact info when you start the case by email, that's why I recommend it to anyone with a tough situation.

Yeah, the boss needs to hear your story in my opinion.

I don't want this to come off wrong, but wouldn't it be easier (and cheaper) to vote with your wallet and go to a different carrier? This company obviously has no loyalty to you, so why should you want to stay with them? The beauty of capitalism is that you have no less than 3 national carrier choices and about a dozen prepaid/regional choices. Instead of a lengthy legal battle with a multi-billion dollar corporation who could throw 20k towards lawyers without blinking, why not just switch?

I never did like sprint... I initially bought my wife a sprint Android based phone and my (at the time) droid x smoked sprints 3g speeds. Needless to say I took the phone back and at that time bought her a htc thunderbolt. She's now on metro pcs unlimited with the 4g lg motion.

Leaving sprint is in the plan but it doesn't help my in laws who are now stuck or the fact that I'm still in contract (which I will fight to get that taken off) or the fact that because of them now my bill will go up at least 20% with another carrier and I'll be forced to buy new phones which I had no plan of doing. I'll be demanding money to compensate for all this plus my wife's and my time to deal with all this.
