No that was a FUD piece.

AOSP is still under the Apache license. What are not open-source are the tools that Google makes to create apps (like the SDK, Lint and Eclipse plugins).

It has always been this way. Nothing changed except some guy in Spain read the license and freaked out without understanding what it means. The license didn't actually change. It was worded that way since at least 2009.

The reason Google does this is that they don't want people forking Android and then taking all the tools Google provides to help Android developers.

People can still fork Android, but they don't get the tools Google gives to Android devs.
