Android isn't totally open, it has copyrighted and proprietary bits, too. Nokia could take the Linux kernel it's based off, but they'd end up with something totally different, anyway.
I'm not familiar with symbian but it sounds like it has the same problem as winmo 6.5: that it and its apps were designed for stylus use and now it is hard to get everyone to redesign everything. There is an advantage, however. If you are in a cold region (such as Finland ), you could wear gloves and still use the device.
