Can I swap Captivate without receipt at ATT?

I paid 420 for it. grand total. Since my phone is still on its way new, I might just straight up list it on ebay and sell it and not bother opening it. There just seems to be too many problems to deal with. Turning off by itself, mail clients not updating, gps not all that great...

Well I don't know where your getting all of this from. Did you already have a Captivate and returned it? If so, why buy on eBay? One can reasonably assume that you have never had one and than you started to read the forums and got buyers remorse. Which is a crazy thing to have if you never had one prior. I have had mine since Aug 7th. I have never had it turn off or restart itself. The mail clients work if you use google. The GPS deal has already been beaten to death and Samsung has come out and stated a fix will be in our hand some time in Sept if not sooner. Than we also have Froyo 2.2 to look forward to which will really turn this phone into one Power house! The old story goes, if you buy a phone early, than be ready to face the initial release bugs and glitches. It is the nature of the industry and all phones have them to one degree or another.

This Forum is NOT an accurate way of telling if Captivates have large issues across the board. This is a SMALL FRACTION of owners, most owners have NO issues and live happily ever after.

Anytime you go on a forum, you should expect a lot of people talking about problems..BECAUSE- its the main reason to even look at a forum..to get help.

DON'T JUDGE all Captivates by the 30 guys who come here to complain.

I'm not really sure what to tell you. Honestly buying something like a high end smartphone sight unseen off of Ebay comes with risks. One of those risks being that what you get may have problems.

I'd say you would do the same that you would do with anything else you get off Ebay that has issues, contact the seller and let them know the item isn't working. I'm not sure how that will work out for you, but sadly thats one of the risks you take on purchasing when from Ebay.

Getting AT&T to swap out a phone does NOT require a receipt, but if you didn't buy it on contract all bets are off. I have bought phones on contract from other sources (non-corp store) and gotten them switched out. But in these cases, they know I bought it and activated and I was under contract, so they have a vested interest in keeping me happy.

If you buy a phone off contract, then your warranty recourse is where you bought it or the manufacturer. In many cases, if you did not buy it from an official retailer the manufacturer can decline to warranty it. Many premium brands of electronics will not warranty items bought of eBay even if the items are legitimate.

My Captivate has been nothing but a pain. The GPS comes and goes and the response time is horrible with the touch screen (give me old-fashioned BUTTONS any day!) Now the 'message' alert continues to go off and I can't stop it; I finally had to mute it. I have rebooted and even removed the battery and it won't stop.

I'm going back to using Sony Ericsson phones which I used for 10 years and regret getting away from! The menus made sense and sending photos and videos to people or websites was a 1-button click!

And what exactly does the above have to do with the OP's question? I understand people are frustarted with the Captivate, but in just about every thread there is someone with one or two posts complaining about how crappy the phone is and how many problems they are having.

Or what is even worse are the ones who have already posted that they have returned their phones for various reasons, yet continue to troll these forums and post in every thread saying how everyone should return their phone no matter what the issue is. This is really getting annoying and it is cluttering up an otherwise informational and helful forum.
