Andriod 2.2 Silent/Vibrate Change with Upgrade HELP!!

Can anyone help with android 2.2 silent/vibrate mode issues?
Before the Andriod 2.2 upgrade the toggle, could turn volume up and down, change to vibrate, and change to silent; however, now with Andriod 2.2, you can only turn volume down and switch to either vibrate or silent, you cannot choose which on you would like. I want to be able to select vibrate or silent just from using my toggle switch instead of having to go into setting every time.
 
I had the same issue, or at least I thought I did. I went into the settings (Menu/Settings/Vibrate/ and ticked "Only when not in Silent mode" and I had my silent phone back.

I haven't been able to get my phone to do any vibrating unless I have it checked to always vibrate. So I always have it be in silent mode even though it shows the vibrating phone icon. It's very annoying when I'm in situations where I want it to be silent, I have to go and take off the vibrate. Then when I need it to vibrate I have to go back in and turn it back to ALWAYS vibrate.

It's really sad that I can't get my phone to work like it did before this last update without rooting or downloading some stupid app.

Yeah there's something wrong with it. It's infested with 2.2. I've done resets, battery pulls, factory resets. I've taken it into the store and nothing has helped. My phone was working perfectly fine before the update. Since the update, well if it had worked like this when I got it, I would have returned it and got something else. You can't tell me that it's my phone since it was working flawlessly before the update. I'm not the only person having these issues either. I frequent other Android forums and there are way too many other people having the exact same issues for it to be my phone.
