They must be... how could the Blackberry Tour legitimately beat out the iPhone 3GS? As much as I dislike the iPhone in general, it's far too popular to be beaten by the Tour, and I might even pick the iPhone over the Tour if I had to pick.

Luckily, I don't have to pick either one of them because I have a better phone.

I know this is cheating, but it's all a sham anyway. I figured I should point out you can vote both from wifi/desktop computer and from your Droid 3G connection and both will count as unique votes lol.
