If apple wins suit, a BAN of HTC phones in the U.S.?

Apple's HTC Complaint Is Officially Moving Forward - Apple htc lawsuit - Gizmodo

The ITC has agreed to investigate Apple's complaint against HTC. It'll be a long process, and this in no way indicates how the ITC might eventually rule, but an Apple victory could mean a US ban of HTC phones.


That'll stink, they will have to stop making phones too! Android will take a major hit with this! Wow apple needs to stop being such p****ys when competition scares them!

What do you guys think? What would that mean for current owners of an HTC device like the Nexus One? Would we just not get updates anymore from google because it's an HTC device or is it just future phones? ... I really hope they don't win.. ughh

Its doubtful that's what a win would mean. Its a civil suit for damages. So HTC would have to pay apple. , and even then they'd go through an exhaustive appeal process. You're looking at years before the outcome is decided. Our n1s and 3gs will be obsolete long before any binding decision is reached. Even if they didn't though, I think its more likely they'd simply disable the features in question with an ota.

HTC has already said they will fight back, which is admirable but a bit scary. We just need to hope this thing gets through quickly, and with not much impact on consumers! Actually isn't Apple itself looking at 2 or 3 cases against them for infringement also? These things tend to take time to work out, but they eventually do. I doubt we, as consumers, will feel any of this since it will most likely end up being settled one way or the other. I personally am so tired of all the patent issues arising lately. I was just reading about the patent MS is trying to get for the windows phone 7 UI, a continuous desktop that scrolls horizontally or vertically past the dimensions of the screen and has multimedia stuff on top of the different desktops. Sounds an awful lot like the UI for android and HTC Sense doesn't it?

Yes, software copyright today is a mess today. It's all screwed up and there's nothing that is a good staple to judge a copyright suit of software. Should be very interesting to watch this case and the many that will start up because of this one.

So even if the ITC rules in favor of HTC, that decision won't come for 45 to 60 days, which means the phones are going to sit on the docks until then and not be available to Verizon customers until June. So no N1 or Incredible until June. Oddly, this is about the same time of the supposed announcement of the iPhone coming to Verizon. Coincidence? I think not.

This makes no sense. They do not have to stop selling the phones or releasing phone until they are ordered to by the court. Assuming this even does happen it will take years.

If Apple were to win an emergency injunction (which I think I ready somewhere they have filed), HTC would be forced to stop selling the phones (unless overturned on appeal) until the main suit has been settled. An injunction ruling will not take years...that usually happens pretty quick, if it's going to happen.

None the less, your original point still applies...nothing will be "just sitting" on the loading docks until such a ruling forces them to stop selling.

Interesting never knew a company had that right. Kind of BS if apple gets it though because its not like these HTC phones are forcing apple out of buisness.
