Actually, TMobile can (and might) do something about this. I wouldn't place the blame on them for this problem, but they have an insane amount of power over Samsung in this issue.
TMobile would be just fine by solely using HTC as their Android phone manufacturer. They could simply tell Samsung, "Take care of the people who buy your phones, or lose a carrier." I'm sure there are contractual details included, but those are easily worked around in situations like these.
