Below is a post made on another dead thread, but i thought some of the info might be useful. I hate this keyboard, I'm not going back to fix that sentence.

Firstly too, I will admit I have had a saga of bad phones from T-mo and this Bh2 fiasco really just was the latest in a long line of bad experiences with tmo phones. I say because they probably went a little beyond the average customer because I have had so many problems and frankly know enough about cell phones from Tmo and other carriers to show them factually that they are not providing the service I pay for. Be cool but don't back down!

I am in warranty and a HUGE Consumerist fan so I've had small claims court as a trump card the entire time just FYI - I don't expect average people to get down and dirty like I did but it worked and frankly I don't feel bad about it because I pay for a working device, something I have yet to receive from Tmo in 13 months or so of service. By working, I mean fully working that is.

and without further ado, this is the post - it's long winded and itself is a summary of the litany of indisputable facts I gave T-mo to illustrate exactly how they were not providing the service I pay for.

Another quick thing I'll mention here that I did not below is that they told me I could choose my phone but by using facts, I showed them that what they were offering were basically downgrades in most respects and that it was not unacceptable. Case in point - If they name a phone, you better know your tech specs! Seriously, because the Bh2 on paper has a lot of things going for it other phones don't have that you can use against them.

BTW i keep saying 'facts' I guess I mean to say, use reasonable arguments. I.e. the battery life does not perform as advertised and the bloatware makes typing impossible. there is really no argument to that kind of shit, so keep your appeals to emotion down to a minimum and try to use a semblance of logic.

I am getting a free Mytouch Slide as a replacement for my BH2 as part of my warranty. Granted, this is part of a long saga of terrible phones from T-mobile, if only the 8900 I originally got didn't go into sos, I would probably still be using it.

But seriously, the gripes with the BH2 are SO reasonable, there is little they can argue. THey will probably offer you something other than a mytouch slide but case in point: if yur BH2 is in warranty, you might have a pretty good shot at getting it replaced with something that sucks a whole lot less.

I have piles of pro tips but here are the key ones - be cool with them on the phone, but don't back down. use FACTS

FACT - Battery life as advertised does not perform even with 3g off, screen dimmed, synch off, gps wifi off, no widgets, etc etc.
FACT - the phone is incapable of being typed on reasonably as stock
FACT - the GPS works only about 50% of the time, but you pay for it to work ALL the time
FACT - The phone was sold under the advertisement that it would get 2.x which has been canceled
FACT (for me ta least) - 3g is up 60% of the time, i pay for 100% (i know i know but for the purpose of talking to CSR's, it has worked for me)
FACT - you love T-mo and are with them because they take care of things like this and that you are loyal etc.
FACT (for me at least) - when I signed my contact nearly 13 months ago, my overage was x, and then it went up to Y which is basically a materially adverse change to the contract and legally you should be let out but I'd save this bomb if the other less assholish and more reasonable facts don't sway them.

and again, I have a long saga with T-mobile and have asked repeatedly to let me out of my contract since they basically are not be able to offer a comparable replacement to my Blackberry 8900, the BH2 was a major step down in a lot of areas but at least it didn't go SoS every 20 minutes in my area.

I literally went to the court house, got a SMALL CLAIMS COURT package and called T-mobile to get the info to fill it out. All of a sudden they were ready to offer me a Mytouch Slide to keep me.


Seriously though, Small Claims Court is an almost guaranteed win for a few reasons: It's cheap for you ($40 to file in my area, but 20$ in others) and takes little time. In some states, they can send a lawyer but most they can't so they will ALWAYS try and settle before the actual trial if you go all the way through it. Basically it's always cheaper for them to settle then pay to fly someone to your little town and run a big risk of losing the trial too. Google this for more info if you are looking into it.

I dont' know about you guys, but I pay basically $75 for the cheapest minutes +data+400 txts and $2 for insurance. I've given them almost $1,000 and I'm a relatively new customer. I want a phone that doesn't suck anus and make me resent signing a contract.

I say take your complaints to 611 so they know how we feel and that we demand satisfaction.

Sorry to get all ranty, but the 20+ hours i've spent on the phone with them trying not to tell them how little they know about cell phones has left me a little bitter. I hope i'll feel better when I know my Mytouch Slide is en route.

I do not receive any benefits from any of the above companies and the views in quotes are not mine just ways to get rid of the bh2 and have not compiled the list myself, I am not responsible for any dealings with these companies, the suggestion are merely just suggestions that I have come across.
 
as I think of various pro tips along the way I'll try and add them.

Don't threaten them with small claims court, actually do it and call them for the info they have to provide to help you with your case. I asked for a record of all service calls, time on the phone, and notes on the account so I knew how much $$ to reasonably ask for in my claim. (they will say you can get your call records online and account notes at a Tmo corporate store)

Try not to cuss or get upset. I am guilty of this, but i know it did NOT help me.

I didnt need to resort to threats of small claims court. As a fan of Consumerist you should know of the EECB. A nice but curt letter and I got a free swap.

I considered an EECB from day one actually, but I was being taken care of via the CSR's so I wanted to stick with that route until it truly dead-ended.


I'm glad you guys are having good experiences with getting a warranty replacement. I was a little concerned that typing up my experience might be wrongly construed as a guide to defraud t-mobile. My main thing was I saw a lot of unhappy folks here and wanted to let them know that there is reasonable recourse.

Personally I WANT to stick with them because I have a $20 data plan and save $5 a month with my more than adequate 400 txt plan.

Remember how the Samsung freebie Lemmings jumped all over me for telling the truth about the lousy performance of the Behold 2 from the start? Well, here we all are months later, lemons in hand, fighting for restitution.

The Samsung Behold 2 was a business-class phone whose potential rivaled the best phones out there. The Slide is a teenager's toy that is already being deeply discounted prior to launch. Shades of Behold 2 are lurking...

I am just trying to avoid getting another lemon in its place.

Walmart is always cheaper. The HD2 is only $100 ($100 off), and the Droid on Verizon is $20 ($180 off).

To whom it may concern,

My name is Matthew Lxxxxxx. My girlfriend and I have been T-mobile customers for a few years now and are very satisfied with most of the service we have received.

However, last fall I purchased the Samsung T-749 Highlight and had numerous problems with it. After multiple exchanges with that device I was "upgraded" to the T-939 Behold II.

On the phone the representative informed me that this device would receive future updates, which we now know is false. On top of that I have had to replace it twice thus far because the screen's backlight will not shut off after a call and I have to power cycle the phone to get it to shut the screen off.

I received my third Behold II today and I still have the screen timeout issue not to mention being stuck on outdated software. Now my choice is to take yet another Behold II, downgrade out of an Android handset that I am locked into paying $25 a month to use, leave T-mobile since my contract will be up, or use my upgrade and get the phone I have to hear is so great from your CSR's every time I call in about an issue I am having with my Behold II, The Mytouch 3G Slide.

I do not think it is very fair that after six plus months of hassles with my numerous phones and waiting for the day I am eligible to upgrade that I should be asked to fork out $200 dollars and however much you lose on the rebates just to get a handset that actually does what mine should and why should I waste more of my time or your money sending me a device that will not work properly and I will not be satisfied with?

I think that all of the hassles I have went through over the last six months should equal the value of the Mytouch 3g Slide after rebates with the new two year contract I would be more than willing to sign. I hope you agree and are willing to meet me halfway.

I know this is a pretty silly well damn near stupid question, but is there any chance the who small claims thing would work for a phone bought from a third party? I know I know you are thinking to yourselves.... really? are you kidding me? I'm just kicking my self for buying this phone now. Unless the petition works I am SOL on getting android 2.x. I can't afford to go the third party route or even the T-Mobile route unless the my touch slide is like $50. So yeah I grasping at anything I can to keep that small dwindling glimmer of hope that I won't be stuck with a crap phone for the foreseeable futue/

I just spent an hour on the phone with CSR, a specialist, and then a supervisor. I thought I was getting somewhere, but the best they could do was to make me re-eligible for the lowest price on the phone.

Worthless because I already paid money out of pocket to get this phone.

Do you think you could PM the letter you used, if it's not too much of a hassle? I'd like to try that before I sell and spend more money. Thanks!

I'm in the same boat. Basically told that it was impossible to get an exchange done and that it's not the phone, it's my sim card? WTF? It worked just fine in all my other phones...

EDIT: I called exec customer service and left a voicemail for the guy I talked to last week. Hopefully he can do something for me :-( Otherwise my cousin in law is a manager for a verizon store... I don't want to switch though :-(

I would advise everyone that has this issue to just keep calling. Everytime you call you will have a different CSR, probably from a different call center with different supervisors. I finally got someone today that was more than willing to help and gave me my pick of devices that were in the Behold 2's class. I chose the blackberry 9700 and she asked me if I did not like the Android platform I told her that I love it but of the phones she offered that were android I did not like any (G1, Mytouch, Cliq, Cliq XT). I was honest with her and said that I was going to get the 3G Slide when it comes out anyway and planned on selling any handset she sent and the Blackberry has the highest resell value. She then took a closer look at my account and seen how close I was to my upgrade date and made it to where I will get a free upgrade when the second shipments of MT3GS's are shipped June 15th and I can keep my Blackberry since the Slide is technically my contract renewal discounted upgrade. Before today all I got was well we can send another Behold 2.

Then again I did not use the Android 2.X update (or better yet lack of) as my excuse. My phones have been messing up. After phonecalls the screen does not timeout at all....... on all 3 Behold 2's I have had.
