Regarding your first issue, it could be the proximity sensor - the sensors are situated to the left of the HTC logo - and how you answer the phone.
If you haven't already, try answering the phone before putting it to your ear. If you answer the phone when it's already near your face, then the sensor will not recognise a difference in proximity and the screen won't automatically lock, as it should. This can also happen if the proximity sensored is covered, so if you're using some kind of phone protector that's covering the sensor, then that might be the cause.
If you prefer an app to solve this problem rather than change the way you answer the phone, then an app like Screen Suite Lockscreen should do the trick. It does a number of other things which may be redundant to you and it may not work in quite the way you want. However, some people experiencing the same issue as you say it solves the problem.
On your other issue, try this, Power off your phone > Remove battery for 30 seconds > Replace and power on. Then check if subsequent deleted pictures are actually deleted.
