Most of the replacements being reported in the forums are refurbs (used phones checked for flaws and "fixed," reset, etc).

Maybe there are some new ones in the box out there, but I doubt it.

Some users talk about having several replacements before getting a good one.

Good luck.

i just got my replacement last week. It was a referb. I tried talking them into something else because I felt mine was a major issue. (when charging it automatically scrolls which would kill my alarm clock, making me 2 hours late for work!)
with no luck on a different handset, they sent me the Eris.... Sigh- Maybe someday.

I called and I'm getting a new one tomorrow too. Mine would shut down 7x in an hour shift. The lag was so bad it would take 10-15 secs after I hit call for it to actually call someone. I tried to do factory resets and clear history but nothing worked.

i got my third eris about a month ago and had usb port issues right off the bat and then the trackball quit scrolling down and now scrolls left and right when ever it feels like it. so i called verizon today and they at first offered me another refurb eris. i asked about an early upgrade, i'm 11 months into a 24 month contract, and he said he would do it for me seeing this would be my fourth phone and i'm only a month away from being able to do a legit early upgrade anyways. they waived the $20 upgrade fee and sold me a dinc for the regular $199 upgrade price which i am happy with.

Well my "like-new certified replacement" just showed up. I just timed the start ups and old was 1:45 and the new 1:10. If the start up time is any indication of things to come I'll be happy.

I was on my second Eris when I developed SMS deliver problems. At first they offered to reset my uprage elegability to allow me to buy something else at a new 2 yr price, but I complained that I just got my Eris in March and was on my second one and did not feel I should have to spend more money. The tech rep said he would talk to a supervisor and call me back if they could give me any other options. They called about an hour later and said that the could offer me an Incrediable on even exchange and swap out all my accessories. They sent me a reman Inc but that's ok because the one I got has the AmoLed screen not the new screen and so far no issues. the Inc is an amazing phone.

My store has refurbs in stock I had an issue with my battery suddenly dying 3 days in a row after being off the charger for an hour. They told me my warranty had expired and I'd need to buy a new battery. I ended up having to escalate to a supervisor to get a refurb for free w/out a battery as opposed to buying a new battery. Now tell me... why would I buy a battery when I know it is the phone and I pay for a warranty every month on the phone?!?! A battery doesn't "go bad" overnight. The "new" phone is 6 days old and I've experienced the MAJOR lag time on the phone, NUMEROUS dropped calls, and the SMS error. I'll be taking it back in tomorrow morning to get another one. The only reason I haven't done it yet is that the Verizon store isn't on my side of town and I don't have the option to just take off work for a morning/afternoon to waste 3-4 hours on a phone swap (most of that time being spent sitting idly at the store waiting on the incompetent customer service reps to figure out what to do with my phone).

I just got a replacement for the first time. I went into the store to see my upgrade options, and found out I can get an earlier upgrade than usual in a couple of months since mine's the primary line, which is about 8 months sooner than I thought I could, so I figure I can make it that long.

The rep also told me that if I keep having problems after a refurb or two more they would swap it for an Incredible... which kind of makes me wish for more problems...

My daughter got her refurb today. Out of the box, it had a worse trackball issue than her current eris with the same problem. Her fourth Eris is being overnighted tomorrow. We have had to replace her phone now three times due to the trackball issue. I am on my second replacement for the same issue.

So, the refurb they gave me earlier in the week started restarting randomly, so I went into the store today and they gave me another refurb. Got home and started setting things up, only to find the speaker was completely blown out, so less than half an hour later I was back for another. Now I'm on my third phone today... here's hoping it works.

I'm counting down the days until my upgrade is available... I just have to make it a few more months.

Update- I'm really starting to think these "refurbs" don't go through much of a fix-up. In the last week I've been to the store a few times, and have gotten 3 refurbished Erises. My original phone had major calling issues, the first refurb suffered from random resets, the second is the one I mention above with the blown out speaker, and the one I have right now has a bum trackball that I can't get to scroll left, but that scrolls left on its own at times. I guess they'll get to give me yet another "refurbished" Eris tomorrow when I go into the store... It's getting really annoying.

You should be to the point where they will entertain getting you a different phone - if that's what you'd like. It seems a common theme that around the 3rd or 4th replacement phone that they'll let you get a different phone. Not sure if the folks at the store will do that, or if you'll have to call the service department to get it done (my guess is that it will require a phone call to service).

I got a refurb cause mine was scrolling to the left. The new one seems fine. I have the call lag every so often. I usually reboot. I have had the lag so bad that when I try to call again, (thinking maybe I didn't hit the button correctly) I end up having 4 or 5 lines calling? Which is wierd. Are there any apps that my be suspect of causing this or overload on the processor or just the phone itself?

Well, I called in and talked to customer service, and they let me do my upgrade early, so now I'm off to the land of the D2!

Just this weekend I called in for a replacement Eris. My trackball has always been acting up, and at this point it just won't scroll down. This isn't really a big problem because I almost never use the trackball, but I've been wanting to root the phone, but I am not confident enough to commence any wiping/backing up/rom flashing processes via command prompts because my trackball can't scroll down.

My hope is that I get a replacement with a working trackball, but it sounds like everyone is having more problems with their replacements (and even working trackballs eventually fall victim to the phone's poor structure). My current phone really doesn't have any other problems at all, and now I am doubting whether I should bother with this replacement.

Poda05, Scary Alien has come up with a process that allows you to flash a new ROM even though you don't have a working trackball. So your last reason to not root is gone now...

Amon_RA 1.6.2 Custom Recovery: trackball not required!

The only 'fix' I've ever heard for this is to root the phone and load a new ROM. Every ROM I've tried has had a nice quick dialer, unlike the stock dialer.

You can stay stock and make the dialer work somewhat better by doing some regular 'house cleaning' on your phone.
Delete the call log.
Keep your old sms messages down to a minimum.
Clear the cache on applications.

Those things will all help, but none of them actually FIX the problem on a stock phone.

even running through google voice, my total click to connected time is less than 5 seconds, which I consider acceptable.

you seriously need some ROM love on that thing.
