Default HTC One X-Upper part of my screen isn't responding

I bought a htc one x white version in less than a month ago and discovered a problem.The upper part of my screen below the notification bar isn't responding,the area marked on red on the attachment.Is this a software issue or a hardware issue? Please guys i need help,my one x is running on android 4.0.4...sense 4.1. If it's a bug,will the bug be fixed on next JB update?

Generally, when the screen stops responding, it's hardware. Can you open the dial pad and enter *#*#3424#*#*, select line test and see if there are any areas of the screen that you can't draw on?

I've got the same problem! Towards the bottom of the screen where you unlock the phone with the ring. At first I thought it might have been too cold for the sensors to work properly, which is still true in some cases I believe. But it's just happen too often now and its soo annoying!!!!
