Don't have a solution for ya (sorry  ), but wanted to let you know that I had almost the exact same experience when I got my Marquee last year. Sometime within the first week I noticed my data connection seemed to be stuck at 1x. It would rarely go into 3G, unless I put it in and out of Airplane mode or rebooted. It would stick for a bit and then revert back. A friend of mine lives a few houses down and his phone, a DROID3 on Verizon, was in 3G constantly. My dad has an iPhone from work on Sprint, and he also had 3G constantly. I tried updating my PRLs and Profiles numerous times, and even went so far as to call Sprint (I know, a nightmare right?) and have them reset my profile from their end. Nothing worked, so I lived with it for a few months.
Out of the blue around January of this year I noticed 3G was sticking. I hadn't done anything special to the phone in that span of time. Asked my buddy what he thought of it, and he mentioned the same thing you already said: Sprint's network upgrade.
I called Sprint for kicks and asked if any towers were being worked on in my area. They said there were 2 being upgraded. My best guess at the time was that the towers in question were simply overloaded for the amount of customers in the area, or they could have been faulty like you mentioned.
Since January, my 3G has been constant. It can be slow at times, even down to 100 kb/sec on speed tests, but it's still there. Take this for what you want, just thought I'd share my similar experience
