Default refurbished motorola droid: notification bar broken?

I bought a manufacturer refurbished motorola droid off of eBay to replace my current one that the speaker stopped working on. After syncing with my google and verizon accounts everything seemed fine until I noticed that I couldn't pull the notification bar down. It behaved as if the touch screen was dead there but otherwise worked fine. I tried doing a manufacturer reset and it still behaved the same.

I ended up sending the phone back to the seller, who has since told me:

This does not make sense to me. I thought that the pull down notification bar was one of the main features in Android 1.0 but maybe I am wrong. Perhaps all this phone needs is a software update. That would be nice as he wants to charge me a 20% restocking fee for returning the phone which to me is unusable without the notification pulldown.

Any wisdom or advice on this? I know I should have noted the firmware and Android Version before sending it back but I neglected to. I assumed it would be pretty straightforward that the seller would exchange it for a working phone.

Hmm, it's been a good long while since I've actually had an original Droid in my hands.

mTeryk, I will second scary alien's welcome to this site.

However, your eBay seller is blowing smoke up your butt. The only thing sort of true that was in his reply was that the Motorola A855 (Droid) was the first Android phone with the "Droid" name, and not only that, it was the one that really put Android on the map. But everything else he says about the phone it totally false. I bought one on release day and the notification bar (and the top part of the screen) worked out of the box. Mine still does.

So, my recommendation to you (as an avid eBay buyer and sometimes seller) is to review the auction and if it states there that the phone is fully functional and the seller still wants to charge you a restock fee, file am "Item not as Described" Paypal claim before you actually settle the disposition of your item.
