mTeryk, I will second scary alien's welcome to this site.
However, your eBay seller is blowing smoke up your butt. The only thing sort of true that was in his reply was that the Motorola A855 (Droid) was the first Android phone with the "Droid" name, and not only that, it was the one that really put Android on the map. But everything else he says about the phone it totally false. I bought one on release day and the notification bar (and the top part of the screen) worked out of the box. Mine still does.
So, my recommendation to you (as an avid eBay buyer and sometimes seller) is to review the auction and if it states there that the phone is fully functional and the seller still wants to charge you a restock fee, file am "Item not as Described" Paypal claim before you actually settle the disposition of your item.
