Obama Quietly Issues Ruling Saying It's Legal For The FBI To Break The Law On Accessing Phone Records | Techdirt

Following the report earlier this week that the FBI regularly broke the ECPA law, in obtaining information from telcos without going through the proper process (and, in some cases using just a post it note!), some interesting details from the full report have come to light. The two key ones? First, "the Obama administration issued a secret rule almost two weeks ago saying it was legal for the FBI to have skirted federal privacy protections." And, second, the original idea to use these bogus "exigent letters" didn't come from the FBI, but from an AT&T employee. We noted in the original report that no one seemed to be placing any blame on the telcos for allowing this, and why they're clearly abusing the law, in giving out such info without the proper rules being followed, seems like a big question:
The telecom employees were supposed to be responding to National Security Letters, which are essentially FBI-issued subpoenas. But those Patriot Act powers say the target must be part of an open investigation and that a supervisor has to approve it. While they require some paperwork, FBI agents have been issuing about 40,000 such NSLs a year.

But an AT&T employee provided the unit with a way around some of those requirements. The employee introduced them to so-called 'exigent letters.' Those letters, first used immediately following 9/11, asked for information by saying that the request was an emergency and that prosecutors were preparing a grand jury subpoena. The letter falsely promised that the subpoena, which gives the telecoms legal immunity, would be delivered later, the report said.

What's more, the report noted that the cozy relationship between the bureau and the telecoms made it hard to differentiate between the FBI and the nation's phone companies.

"The FBI's use of exigent letters became so casual, routine and unsupervised that employees of all three communication service providers told us that they -- the company employees-- sometimes generated the exigent letters for CAU personnel to sign and return," the inspector general reported.

In fact, one AT&T employee even created a short cut on his desktop to a form letter that he could print out for a requesting FBI agent to sign.

Even that became too much. Agents would request "sneak peeks," where they'd ask if it was worth their time to file a request on a given phone number, the inspector general noted. The telecom agents complied. Soon it graduated to numbers on Post-it notes, in e-mails or just oral requests.
No wonder the telcos were so adamant about getting immunity on the warrantless wiretapping. It appears that the issue of telcos ignoring the rules when it came to your privacy goes pretty deep.

As for Obama issuing a rule saying that breaking the law is legal... how does that work? The president doesn't get to just declare something legal, especially when it clearly violates both the letter and intent of the law.

Oilbama is as bad or worse than Bush in this and many regards, but you'll be hard pressed to find members of his cult of personality that will admit it and hold his feet to the fire. The way the wind blows seems to greatly affect the perception by liberals on the legality of what a president does.

I doubt in his entire life Obama has done anything negative in a major way that would be the "same or worse" than the incompetencies or crimes perpetrated by the previous administration.

That the far right thinks that or tries to convince others of it only makes the far right look sillier...if that is possible.

It's always hilarious to see the far lefties run in circles from their dizzying denial to protect their Kenyan!

Remember far left wingnuts screaming about the Patriot Act? Hmm? Your Kenyan supported the Act since he took office, so....

It's pleasing that the far righties are so angry...it fortifies my belief that the current admin is doing mostly the right things.

In november, the repubs likely will not pick up enough seats to control either house and will be left with only more obstructionism. The republic will still be safe from their machinations.

One, I don't read anything in my post that could be considered whining.
Two, I never stated my stance on anything. So, I'm not sure where you got that I now support something I have never supported from. I find it interesting that you now no longer support it now that Obama does though.
I also never stated what party I am part of. For the record, I am part of no party as I support views from both sides.

You come in here spewing hatred, hypocrisy and racist undertones, yet you want to throw that label on some-one else that has done neither.

Iraq was not involved with the twin towers.

As someone who does support Obama, I am disappointed so far in his ability to govern. I am all about giving a guy chances, but he has been timid and his policies (besides the health care bill) has been very similar to Bush Jr. The man is very inspiring when he gives a speech, but after awhiles it is rhetoric. Just so happens his is "happy" rhetoric and Republican uses "doom and gloom" rhetoric. While I understand a single person can't do everything, I am not happy with things that he can control.

But for now, the main advantage Obama has going for him is I feel like pretty much any Republican running for office is downright bad. Sadly though, Democrats are not far behind.

And honestly, I would rather have had neither as well. I'm still supporting robin williams for president. Sadly, we need to pick between the lesser of two evils these days. There is no reason in a presidential race that 4 or 5 or more candidates should be present. Also sadly, it seems the greatest of the two evils won in 2008. It was funny watching the house speaker on CNN get booed off the stage by DEMOCRAT LIBERALS no less regarding the obamacare plan. There is hope after all.

I find it interesting that (almost) everyone is playing these moral-equivalence games. (Think this guy's bad? He's not as bad as that guy over there, and that makes him ok!) Wrong is wrong, folks. My daddy raised me to keep promises and not to make any that I can't keep. If more politicians were raised like that, campaigns would be much cheaper & quieter but I think our gov't. might not be one huge bicker session.

The Health Care Bill is no more socialist than our military, police force, fire department, public roads, social security and medicare. The bill was a darn insurance bill that benefited insurance companies by giving them more of government money and forcing everyone else to buy insurance. A true socialist health care bill would have, for starters, a public option. There would be a medicare system for more people than just the elderly. Or it'd just simply be a massive single payer system. So people can dislike the health care bill for many reasons, but to freak out that it is evil because of how outrageously socialist it is, is just wrong.

I agree. And that is what is sad about our leaders. For so long we are simply having choose what we believe to be the lesser of two evils. Problem is, the lesser of two evil is still pretty bad. And so as a nation we keep going downhill.

Please show me the proof of this. I've googled the question, and multiple sources including a reputable newspaper have reported that he is a christian.

His father was muslim, but his mother raised him christian. Apparently his father decided to no longer be a muslim before Barack was even born.

And don't argue that I should be the one to find the proof; it's your argument, you back it up.


And anyway, what does it matter if he were a muslim? I thought you were intelligent, it seems you're just another bigot.

I hardly believed you searched anything, its plastered all over youtube, several different videos. Even one of obama bowing to a muslim king. Wtf? Our president bowing to a religious "king"? Eff that.

Or maybe when he refused to salute our american flag during the national anthem? Eff that too.

As for abortion, no I don't agree with abortion. People should take responsibility for their actions. The only cases I feel abortion should be an option are rapes, and when it puts the mother in physical danger. That's it. Maybe it'll make people think twice about opening their legs to every guy/girl they meet at a bar. Might slow down transmission of std's too.(maybe)

You don't work, you don't eat. Plain and simple. Unless you have a physical/mental handicap that prevents you from working, you starve.

Why should some person in the ghetto get a home, food, a car, cell phone, cable, and all the other goodies in life without working a day in his life, when I work for everything? Eff that. Seriously, eff that. Taking my tax dollars to pay the way for some lazy pricks to stay home and watch maury all day? Effff that.

That is exactly the reason why I disagree with liberals so much. But I disagree with conservatives on a lot of issues too. Like why give tax breaks and subsidies to large multi-billion dollar corporations? Eff that too. I know, since I'm know picking sides its blasphemy. But I am picking a side. The side of Americans.

Hey Iowa. Sorry. I really do think you are a very moderate and reasonable person. I was just listing some stuff off the top of my head that are religious and political as well. When I brought up abortion, it was because the largest group of people against abortion are against it because their religion says life starts at conception. And they want to make laws based on that.

As far as I know (and that means as it means, as far as I have seen, read, heard etc), Obama is not pushing to pass laws based on his religious belief. If he is Christian he isn't saying the U.S Constitution should be based on the Bible, or that American was founded as a Christian nation, or he isn't trying to pass laws to prevent women from making their own choice as to have an abortion or not just because his religion says its wrong. If he is Muslim, I don't see him trying to pass laws that women have to always have a male family member escorting them in the streets, or women having to wear a burqa.

As such, I don't care what religion Obama follows as long as he doesn't try to make laws based on his religious beliefs. However, I am against Sarah Palin because I believe she will try to push laws based on her religious beliefs and I do not support that.

Hmm very good find. The bill is certainly far from perfect. It is indeed an unfortunate product of our rather befuddled political system. But, I didn't claim it was perfect or even good. Just said it wasn't so evily (not a word, I know. Sorry) socialist.

How? 15 minutes after the Underwear bomber was taken into custody he was Mirandized on Eric Holder's (meaning Oilbama's) orders. Community services are different, as I explained above. You nor anyone has a right to health care. Health care reform is needed, but the OilbamaCare bill is more fail than we can afford. Already the CBO has come out and said this bill will cost much more, and it hasn't even started! Seems that now that we can see what is in the bill - thanks Pelosi! - there is a heckuva lot that is excessive. the most hysterical thing about politics anymore is left/right wing...

There is only one wing and they do their best to make sure we vote left/right by creating turmoil on the radio/tv between the two... It gives everyone a feeling of I must vote one way or the other...

Imagine we all sat back listened to everything everyone said and never saw the candidate or knew the political party they were affilliated with?

What we would have is an honest and educated election in which the best person for the job would win...

Look around your big corporations... How many people were/are hired/interviewed simply due to race/gender/etc.

If you want the best candidate you would name everyone "john doe", read their credentials interview them by phone and then have a face to face meeting...

Guess who wins the job? The most qualified PERSON... It's really that simple...

Nah instead they have us picking sides and letting complete republican vs democrat bs be the deciding factor on who gets elected for the most important position in the world...

As for the Fort Hood, I would agree it was a terrorist attack. It is in the same line as the OK City bombing and the crazy nut case that flew a plane into the IRS building in Texas.

I don't support a court martial of our troops over the singular word of a terrorist. But I wouldn't go for using this as evidence that Obama supports Muslim terrorists. In this specific case the military way over reacted. This was just one man's word that he was abused without evidence so the whole trial is a waste. Thankfully they were acquitted.

In any event, I do not believe the POTUS is involved in a court martial. I mean as far as I know, I don't believe a President orders a court martial. You were in the military, you would know more about that than me. The "blame" that everything is the POTUS' fault while it is on his watch can only go so far. If Obama single handedly pushed for the court martial then he has mind control powers over nearly everyone because there are a lot of people involved in the whole process.

My personal opinion is based on what I have heard from Palin. Given, she is not the President so obviously there is no body of work, but her words have been enough for me to not vote for her.
