Did anyone contact any lawyer or the better business bureau so far?
I would not be so quick to say that T-Mobile is not responsible for this, I think that if they wanted the upgrade to be done, Samsung would have done it. Samsung released Android 2.1 for Samsung Moment that is sold by Sprint, so how difficult is it for them to release an update for Behold 2?
And where is Google in all this? The BH2 has the Google name printed on the back. Don't they have a vested interest in solving this mess? It's a cautionary tale for people to choose the iPhone over Android, because you are guaranteed at least 36 months of support for your smart phone. With Google, nothing is guaranteed, not even for a week.
What about G4 attack of teh show or MSN?
Heck even Good morning america we just need as much bad publicity as possible.
this is a new device and it was dropped a few months after it was released

I plan on calling T-mobile tomorrow "Samsung Mobile and T-Mobile USA are planning to update the Behold II to Android 1.6........" that shows they lied to us almost as much as Samsung. I planned on just getting the MT3GS and staying but with that line they lost my loyalty. Hello Verizon my my your Droid is INCREDIBLE!
just got off the phone with tmo customer loyalty they said they could "offer" "something" now but if i take it i won't be eligible for whatever agreement they reach with samsung and he felt confident one would be reached much like microsoft did during the sidekick fiasco. he put in the trouble ticket and suggested i wait two weeks to see the out come and if nothing had happened by then at least they will have a phone on 2.x (i.e. the slide) because nothing he could offer tonight would have 2.x out the box.
yeah...well ...we'll see what happens i guess. he implied that at the very least i would be able to get full upgrade on the slide if not an outright trade in and mentioned that samsung actually has a high end android coming to tmo...duh galaxy s anyone...and that just maybe it would be part of the "settlement" this was all implied though...nothing was promised except that they would "get me a new phone"

What did you say for them to Side with you though?
actually wasn't hard at all...almost like he already knew though he claimed he did not. i actually read the statement to him. but he was a former behold 2 owner as well and knew the back ground. he actually said i was very lucky i got him on the phone as he is, as he put it, a "geek" and an android geek at that

i have a buddy that works at AT&T and I can tell you right now that he was bullsh*tting you. Trouble tickets are only for technical issues.
Did anyone contact a lawyer so far? There are plenty of lawyers that deal with class action. If anyone did, please answer in the forum or send me a private message. Thanks.
^^that has always been my experience with tmo as well...i'm not worried i will be getting a new phone and it will have android 2.1...its the power of positive thoughts. plus i had a nice time chatting with this guy anyway

Well reason I asked is now that it's official I was thinking about calling again..
I would at least put in the ticket the more that do more tmo will push samsung for a decent resolution for us. I just told him the facts that US law protects consumers from false and misleading advertisements and that samsung was really misrepresenting tmobile. I told him I know tmo customer service is better than that and that I know they can support their users and he agreed and he personally felt conversations between tmo and samsung had already begun though again he would not really comment. I was very calm and extremly respectfull of tmo

I guess I'm wonder how the convo went, as I blow up on tmo today when I called.. So was Looking at Pointer on how you spoke to get the replies you got..
Customer care moreless said FU to me, but, then again the rep asked me if I would like to can my contract after I said that's the only way I feel like I'm going to get out of this phone..
ok so the first person i spoke with was a general csr that person was an idiot and transfered me to pda department. i was given the run around from that rep actually and even got the bullshit offer of a blackberry and she also mentioned that g1 users are being "upgraded" to the behold 2 as they are phasing it out. i said that was unexceptable and pleaded my case she finally spoke to her supervisor who recommended i talk with customer loyalty. this is were things turned around. i was lucky and got a rep that knew what he was talking about and actually seemed to generally care about tmo's great customer service reputation from there the convo went as i already described above...i'm sure it didn't hurt that he was a former behold2 owner and knew the background, but like i said i was calm and extremely respectful of him personally as well as tmo as a company

I hear ya on this after reading the news I was irate and wanted to call right then and blow up but the House Boss advised me to get cool first and when I did call as soon as I got through to a general CSR I very politely asked to speak to a supervisor in the smartphone/Android department and after explaining why I was calling and that had this info came out last month when I upgraded and had the sales rep at my corp. store not shown the video promising Android 2 I would have waited for the Slide he passed me to Costumer Loyalty and for now I am happy with the out come.
on a side note I know I saw earlier this week that the Slide was coming out on 16 June but the TMO site shows 02 June as the release date, anyone know if that is online/over phone only or is that Corp. stores also?

even if they gave me a Galaxy S I would just sell it to the first sucker who ask about it. and finding out the Slide is coming red and black not just white makes it all that much better
edit : unless they offer to buy back the BH2 I will keep it around as a back up with whatever ends up being the absolute final ROM by Eugene, his ROMs and rooting the phone are the only reason I haven't dropped it out the window of my big rig

Ok, so I will be calling back T-mo executive offices tomorrow. I downloaded an app that automatically records my convos. "vrecord" or something. So if anything is said, I will have the number dialed, the time, the date, and the whole convo recorded. If t-mobile is willing to let us trade our beholds in for a 2.x phone the the slide 3g or god forbid the galaxy s, I'll do it... But I would still be out for giving samsung bad rep. Not fair to T-mo to have to cover their ass. I'll let you guys know what is said tomorrow.
If we take the galaxy s, though it would suck to have samsung involved, I think tmo would be more apt to go for a samsung to samsung trade that way Sammy takes a hit too if they give the slide then samm gets off and tmo gets hit twice as hard

No phone in their current line up is 100% sure of getting beyond 1.6.
I just called and all i got was an offer to get a Blackberry Curve. Nope.
Actually yes, you can be 100% sure. There is just no guaranty that any phone will be UPGRADED to eclair/froyo. The MT3G and the G1 have available 2.1 roms.

Check the legality of that. I'm pretty sure in Washington state, you need all party's permission to record a phone conversation. (by which I mean, I know that it would be illegal on a person to person call, there's a slight possibility that the exception that lets businesses record calls might allow you to do that)
My name is Mike Xxxx. I have been a T-Mobile customer for a while now, and have no plans of leaving. I have always received great customer service from all of your employees. I received a call the other day from one of your executive employees, but forgot to get a return number and forgot his name. Basically, me along with hundreds more owners of the Samsung Behold 2 had been deceived into purchasing the phone for promises of a Android OS 2.x update. Most of us purchased the phone based on this, and now Samsung has offically declared it will only be getting 1.6. Here are a few links to catch you up a bit.
Located in those links you will find many angry customers. Not so much at T-Mobile, but at Samsung. Most of us spent a few hundred dollars, on top of a new or extended 2 year contract to get this phone knowing that it would be updated to 2.x. Now that it is NOT getting the update, we're not sure what to do. We know that Samsung has the Galaxy S coming out, so one of our solutions was to replace our phones with the new Galaxy S which will COME with Android 2.x pre-installed. However, some are more cautious and just want a refund or another Android 2.x phone entirely. Please let me know ASAP what T-Mobile can do for us. Feel free to call me at xxx-xxx-xxxx. That petition was started 3 days ago, and already has 600+ signatures and we have been published on most Android fan sites as news stories. Please help us T-Mobile. Thank you.
Mike

So I just called about the issue I am having with the screen not shutting off after a phonecall. I did not mention this issue. They are now sending me my third behold 2 in a week and the girl noted my account that if I have the same issue with this one I get my pick of any phone in their line-up since this is my second phone that will qualify for the no lemon policy. I would advise everyone to make up a issue with your phone and have them replace it do that three times and voila you have a different handset. They do not verify that the phone is actually having the issue and if they did you can just blame it on your sim card. Best of all the exchanges go through Samsung not T-mobile (except the last one where you get a new handset)

After all this talk about replacements, I'm still wary that it will actually happen. I'm an EM+ subscriber and bought my phone outright. I think Tmo will treat standard post paid subscribers differently than EM+, even though I've been with Tmo for 6 years and have 4 lines with them.
We want you to know that Samsung appreciates you helping to bring this matter to our attention. Samsung is immediately releasing the following information to clear up any confusion regarding planned upgrades for the Behold II: "Samsung Mobile and T-Mobile USA are planning to update the Behold II to Android 1.6 which provides access to Google Maps Navigation, Google Voice Search capability and quick search box for Android. The update will also supply additional benefits including Swype, an improved Media Player, updated core Android applications and improved Bluetooth capabilities. However, the Behold II is not upgradeable beyond Android 1.6."
Additionally, we are researching any previous statements made about the planned upgrades for the Behold II to rectify misstatements, if any, that may have been made. Please know we review and appreciate comments, positive and negative, made by people like you, our customer, and we take them to heart. Our goal is to always provide the best possible handsets that not only meet but exceed your expectations, both in quality and functionability.
@mwl1119, don't you need to have insurance on your phone for this to work?
@SteveSlimer, what do EM+ owners, who purchased the phone outright (or are making payments), have as options?
Thanks in advance.
EDIT: behold_this, and anyone who has been having luck with TMO's support -- What are your phone plan's details? Are any of you on the EM or EM+ plans?

I have the old MyFaves unlimited with Anrdoid and 400 texts
just remember when you call then just be VERY polite and curtious... it goes a long long way. also make sure you point out that had it not been for Samsung's promises you would have gotten a different phone or waited for one of the up coming ones like the Slide. Because unlike Samsung, TMO understands word of mouth can be a killer in any business big or small

Not according to who I talked to. All my exchanges were done under warranty.
I haven't tried to talk to CS just yet. I should be focusing on the last week of my wife's pregnancy instead of focusing on how my phone won't be updated.
Ok, for the people using T-mo to cover their phones, we really shouldn't do that yet guys. Why should T-mobile have to pay for Samsung's f up? If they are willing to, then great, but we should find out what happens first.

It's very simple. They, as a wireless carrier, have chosen to use Samsung products. In doing so, they take on whatever baggage Samsung collects along the way. They can either A) Force Samsung to make it right by updating our phones or B) Cover for Samsung and provide us with some sort of compensation/replacement.
They're in this together regardless of how nice people want to be to TMobile.

Actually it's just as likely that Tmobile is as much a victim as we are. They could have been misled by Samsung into believing that they would support it. Personally I'm giving T-Mobile time to decide which camp they want to be in. And Tmobile has a much bigger interest in keeping us as customers than samsung does. Hopefully they will either force samsung to make this go away, or steps up to the plate and cut us a deal themselves.
Or they could just sit back and do nothing. At this point it's there choice, and the best way to deal with them is get them to identify with us. By being nice.

I'm not saying they're to blame, but it is still just as much their responsibility as Samsung's to help in correcting this error. While I want them to side with me, I won't be happy with getting a full discount on the Slide, because quite frankly, I already paid money for a phone of theirs and I'm not about to again 2 months later. I'd prefer they refund me for the BH2 and allow that to go towards a full discounted Slide. That is what should be happening. They sold us a bad piece of equipment and they should correct it.
Them being victims in this shouldn't end up with us spending more money to get out of this.

True, especially since I paid cash for my BH2, and could buy a subsidized phone anyways, so the discount gives me nothing. And I'm sure I'm not alone. I'm just waiting for Tmo to do the right thing/pistolwhip Samsung into submission.
I posted in the thread discussing talking with TMO about the issue. While I actually agree that they're not to blame entirely (though their reps were spouting the information from Samsung based on the life expectancy of the device) I've lost my patience. The representatives I have spoken to are unwilling to acknowledge there's a problem. Good luck to anyone who is dealing with them.
