Default New Captivate from RadioShack Black Friday a refurb/returned item???

Hi guys,

I just bought a new Captivate from RadioShack for Black Friday and I have a few concerns that the phone I received might be either a used/refurbished/returned item.

The reasons I suspect so are as follows:

- The seal was different from when I bought a Captivate from Best Buy, it looked like someone had taken off the original circular seal and replaced it with a square seal (in fact you can see the imprint of the old one underneath the square seal).

- The sticker that says " Txtng and Drvng... It Can Wait" is different also. It has a flap on the top right corner for easy peeling. Again, the ones from Best Buy didn't have this flap.

- Finally, and my biggest reason for suspicion: the phone already has the 2.1 update 1 firmware installed, whereas 0 out of the 3 I got from Best Buy had this. They only had 2.1, not the update, and I had to update them myself. Are new batches of Captivates shipping with the update 1 already installed?

Also there is this article from 2009 that basically warns that RadioShack does indeed sell used/refurbished/returned items as new >> More Insider Tips When Buying From Radioshack - The Consumerist

The phone itself, as far as I can tell from the 3 hours I've had it, performs more or less ok. I just want to know if anyone has had bad experiences with RadioShack products that would confirm my suspicion and if there is anyway to know for sure if I've been duped - or if I'm just being cynical and paranoid.

Hopefully they are new. Just converted my dad over from bb and he picked one up this morning. Have not had a chance to look or mess with his phone but maybe I will go over late this weekend. I am giving him a 16gb sd card so he can expand his memory.

I think there's a way to find the production date. Then you can see whether it should have the j7 update or not. Just a thought.

I wouldn't worry about it.

AT&T gives its authorized dealers "return rights" on new phones, as long as they aren't really old aging inventory. This means if somebody buys a new Captivate, then returns it to RadioShack or BestBuy or Wirefly or whoever, the dealer can send it back to AT&T for full credit. So Radio Shack would have absolutely no incentive or reason to sell you a phone that had been returned.

That doesn't mean it's impossible for the phone to have been opened or even activated before. Orders can come in and the phone gets activated and processed for shipment, then the order gets cancelled before the phone ships out. Probably not common, but in those cases, I'd expect the device to be returned to the shelf to be sold to the next guy.

Maybe just go back to RS, explain your concerns and ask to see other sealed boxes? If they all look like yours, maybe thats how RS gets theirs.

The captivates with JH7 pre-installed have a square sticker instead of the circle one. Your IMEI label should say JH7 on it (indicating the latest firmware). The texting while driving sticker with the tab is also normal, they started doing this awhile back.

Yep new captivates do have 2.1-update 1 JH7 preinstalled.

Yup the one I got from Walmart has the new update on it. If you got one of those "free" ones from Radio Shack it probably is a refurb/used. Nothing free is ever truly free.

Got one from bestbuy on tuesday.. they price matched wal-mart and sold it to me for a penny and it has the update and JH7 on it.

wonderful i got my captivate at radioshack......it seems legit....i really hope i don't run into any problems throughout my contract! I thought I was being a knowledgable consumer, guess not
