Stuck on 4.0.4 - Kies not updating

I'm trying to update a GS3 to Jellybean. The phone is an insurance replacement from Orange in the UK. My previous GS3 was able to update to JB

This new device doesn't allow checking for updates in the settings menu so i'm stuck with whatever Kies says. Is it a windows 8 problem? other device was updated using Windows 7

I don't want to flash my GS3 since it would void the warranty/insurance, no?

Any advice would be appreciated - thanks.
