Default Do I have any leverage?

I bought a Samsung Captivate in July. I love it, it's great. However on three separate occasions, I was unable to receive text messages (I became aware when the senders asked why I didn't respond). After the first time it happened, I tried restarting it, uninstalling several applications but nothing worked. The guys at the ATT store didn't know what to do either. I eventually did a factory reset and it started working again. The next two times it happened, it started working after a restart, however I still missed several important messages. In my eyes, this is unacceptable. I called ATT after the second time and the nice lady on the phone told me I need to restart my phone daily to reestablish connection with the towers (no...?). Now I really don't trust their network. I know they will offer me a new phone, but how do I know it won't happen again? Ideally, I would like to get out of my contract and switch services, but I know this is unlikely.
What do you think the chances are of being able to get out of my contract?

it dont look good... 5 month later???


but you never know.. keep asking.. making noise. report it everytime it happens...

most likely you will get another captivate. cancel service contract is a long shot.

I do think that is not normal. Maybe a replacement phone will fix it.

May be your sim needs to be reprovisioned.

Since you already tried a new SIM card, then we'll dispense with that suggestion. If it happens only in one location (home or work or wherever you are most of the day) it could be a marginal signal. My office is located in a fringe area of AT&T and we have calls dropped in different parts of the building, however SMS messages usually make it through. I'd have to think it was a faulty phone, since it isn't a burning issue in the forums. Exchange the handset, although if memory serves, after 5 months the warranty covers replacement with a refurbished phone and not a new one.

I would say 3 lost text messages in 5 months is not something that At&t or most of the world is going to be too concerned about. If it is business critical, I wouldn't use text, oh, wait, that's right I never use text anyway

I would say you are stuck with the contract, there are early termination fees or maybe you can convince them to swap for a different device.

Your best bet might be to pay the early termination fee ($275 or so) and sell the device on Ebay if you really want to go elsewhere.

It wasnt 3 lost messages, it was three instances in which I wasnt able to receive any messages. It was days at a time. I missed many messages. Its not business related but there were still several important things that I missed.
