Ok folks, HTC is officially full of crap. The XDA devs came up with a hack proving the hardware is absolutely capable of fps>30. There are two test kernels out right now, both exceed the stock limit. These kernels break things the average user will want like movies and the camera, so they aren't ready for prime time yet, but rest assured, your Evo is ready to perform as soon as the wizards at XDA get their hands on the HTC source. I'm not sure what the impact of the upcoming OTA will be, or whether the recently announced 2.2 will be on this fps issue, but the good news is your EVO can and will perform once the OPENSOURCE devs go to work! Here are a few pics to hold you over. 52fps comes from t1 kernel, 39fps comes from t2, and 28fps is stock.
