Bought used eris with 2.1 leak. Questions

I bought my phone with the 2.1 leak already installed from the previous owner. Ive been skimming through the forums and think I may have confused myself. Since the phone has a leaked version will I get the OTA update.

How can I tell if the phone is rooted already?

Came from blackberry storm. Androids pretty new to me.

If you have the 2.1 leak, you won't get the OTA since you technically already have it. And if you have a leaked ROM, you can't root as of now.

Same thing happened to me today. Bought a used Eris and turned out it had 2.1 leak on it (which I need as I'm on Cricket). I'm going to resell it and buy another one.
