    1360. THE PROGRAM CONSTITUTES RECIPIENT'S ACCEPTANCE OF THIS AGREEMENT.
    1361.  
    1362. 1. DEFINITIONS
    1363.  
    1364. "Contribution" means:
    1365.  
    1366.       a) in the case of the initial Contributor, the initial code and
    1367.          documentation distributed under this Agreement, and
    1368.       b) in the case of each subsequent Contributor:
    1369.  
    1370.       i) changes to the Program, and
    1371.  
    1372.       ii) additions to the Program;
    1373.  
    1374.       where such changes and/or additions to the Program originate
    1375.       from and are distributed by that particular Contributor. A
    1376.       Contribution 'originates' from a Contributor if it was added to
    1377.       the Program by such Contributor itself or anyone acting on such
    1378.       Contributor's behalf. Contributions do not include additions to
    1379.       the Program which: (i) are separate modules of software
    1380.       distributed in conjunction with the Program under their own
    1381.       license agreement, and (ii) are not derivative works of the
    1382.       Program.
    1383.  
    1384. "Contributor" means any person or entity that distributes the Program.
    1385.  
    1386. "Licensed Patents " mean patent claims licensable by a Contributor
    1387. which are necessarily infringed by the use or sale of its Contribution
    1388. alone or when combined with the Program.
    1389.  
    1390. "Program" means the Contributions distributed in accordance with this
    1391. Agreement.
    1392.  
    1393. "Recipient" means anyone who receives the Program under this
    1394. Agreement, including all Contributors.
    1395.  
    1396. 2. GRANT OF RIGHTS
    1397.  
    1398.       a) Subject to the terms of this Agreement, each Contributor
    1399.       hereby grants Recipient a non-exclusive, worldwide, royalty-free
    1400.       copyright license to reproduce, prepare derivative works of,
    1401.       publicly display, publicly perform, distribute and sublicense
    1402.       the Contribution of such Contributor, if any, and such
    1403.       derivative works, in source code and object code form.
    1404.  
    1405.       b) Subject to the terms of this Agreement, each Contributor
    1406.       hereby grants Recipient a non-exclusive, worldwide, royalty-free
    1407.       patent license under Licensed Patents to make, use, sell, offer
    1408.       to sell, import and otherwise transfer the Contribution of such
    1409.       Contributor, if any, in source code and object code form. This
    1410.       patent license shall apply to the combination of the
    1411.       Contribution and the Program if, at the time the Contribution is
    1412.       added by the Contributor, such addition of the Contribution
    1413.       causes such combination to be covered by the Licensed Patents.
    1414.       The patent license shall not apply to any other combinations
    1415.       which include the Contribution. No hardware per se is licensed
    1416.       hereunder.
    1417.  
    1418.       c) Recipient understands that although each Contributor grants
    1419.       the licenses to its Contributions set forth herein, no
    1420.       assurances are provided by any Contributor that the Program does
    1421.       not infringe the patent or other intellectual property rights of
    1422.       any other entity. Each Contributor disclaims any liability to
    1423.       Recipient for claims brought by any other entity based on
    1424.       infringement of intellectual property rights or otherwise. As a
    1425.       condition to exercising the rights and licenses granted
    1426.       hereunder, each Recipient hereby assumes sole responsibility to
    1427.       secure any other intellectual property rights needed, if any.
    1428.       For example, if a third party patent license is required to
    1429.       allow Recipient to distribute the Program, it is Recipient's
    1430.       responsibility to acquire that license before distributing the
    1431.       Program.
    1432.  
    1433.       d) Each Contributor represents that to its knowledge it has
    1434.       sufficient copyright rights in its Contribution, if any, to
    1435.       grant the copyright license set forth in this Agreement.
    1436.  
    1437. 3. REQUIREMENTS
    1438.  
    1439. A Contributor may choose to distribute the Program in object code form
    1440. under its own license agreement, provided that:
    1441.  
    1442.       a) it complies with the terms and conditions of this Agreement; and
    1443.  
    1444.       b) its license agreement:
    1445.  
    1446.       i) effectively disclaims on behalf of all Contributors all
    1447.       warranties and conditions, express and implied, including
    1448.       warranties or conditions of title and non-infringement, and
    1449.       implied warranties or conditions of merchantability and fitness
    1450.       for a particular purpose;
    1451.  
    1452.       ii) effectively excludes on behalf of all Contributors all
    1453.       liability for damages, including direct, indirect, special,
    1454.       incidental and consequential damages, such as lost profits;
    1455.  
    1456.       iii) states that any provisions which differ from this Agreement
    1457.       are offered by that Contributor alone and not by any other
    1458.       party; and
    1459.  
    1460.       iv) states that source code for the Program is available from
    1461.       such Contributor, and informs licensees how to obtain it in a
    1462.       reasonable manner on or through a medium customarily used for
    1463.       software exchange.
    1464.  
    1465. When the Program is made available in source code form:
    1466.  
    1467.       a) it must be made available under this Agreement; and
    1468.  
    1469.       b) a copy of this Agreement must be included with each copy of
    1470.       the Program.
    1471.  
    1472. Contributors may not remove or alter any copyright notices contained
    1473. within the Program.
    1474.  
    1475. Each Contributor must identify itself as the originator of its
    1476. Contribution, if any, in a manner that reasonably allows subsequent
    1477. Recipients to identify the originator of the Contribution.
    1478.  
    1479. 4. COMMERCIAL DISTRIBUTION
    1480.  
    1481. Commercial distributors of software may accept certain
    1482. responsibilities with respect to end users, business partners and the
    1483. like. While this license is intended to facilitate the commercial use
    1484. of the Program, the Contributor who includes the Program in a
    1485. commercial product offering should do so in a manner which does not
    1486. create potential liability for other Contributors. Therefore, if a
    1487. Contributor includes the Program in a commercial product offering,
    1488. such Contributor ("Commercial Contributor") hereby agrees to defend
    1489. and indemnify every other Contributor ("Indemnified Contributor")
    1490. against any losses, damages and costs (collectively "Losses") arising

    1500. Commercial Contributor in, the defense and any related settlement
    1501. negotiations. The Indemnified Contributor may participate in any such
    1502. claim at its own expense.

    1504. For example, a Contributor might include the Program in a commercial
    1505. product offering, Product X. That Contributor is then a Commercial
    1506. Contributor. If that Commercial Contributor then makes performance
    1507. claims, or offers warranties related to Product X, those performance
    1508. claims and warranties are such Commercial Contributor's responsibility
    1509. alone. Under this section, the Commercial Contributor would have to
    1510. defend claims against the other Contributors related to those
    1511. performance claims and warranties, and if a court requires any other
    1512. Contributor to pay any damages as a result, the Commercial Contributor
    1513. must pay those damages.
    1514.  
    1515. 5. NO WARRANTY
    1516.  
    1517. EXCEPT AS EXPRESSLY SET FORTH IN THIS AGREEMENT, THE PROGRAM IS
    1518. PROVIDED ON AN "AS IS" BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY
    1519. KIND, EITHER EXPRESS OR IMPLIED INCLUDING, WITHOUT LIMITATION, ANY
    1520. WARRANTIES OR CONDITIONS OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY
    1521. OR FITNESS FOR A PARTICULAR PURPOSE. Each Recipient is solely
    1522. responsible for determining the appropriateness of using and
    1523. distributing the Program and assumes all risks associated with its
    1524. exercise of rights under this Agreement, including but not limited to
    1525. the risks and costs of program errors, compliance with applicable
    1526. laws, damage to or loss of data, programs or equipment, and
    1527. unavailability or interruption of operations.

    1529. 6. DISCLAIMER OF LIABILITY

    1531. EXCEPT AS EXPRESSLY SET FORTH IN THIS AGREEMENT, NEITHER RECIPIENT NOR
    1532. ANY CONTRIBUTORS SHALL HAVE ANY LIABILITY FOR ANY DIRECT, INDIRECT,
    1533. INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING
    1534. WITHOUT LIMITATION LOST PROFITS), HOWEVER CAUSED AND ON ANY THEORY OF
    1535. LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING
    1536. NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OR

    1543. applicable law, it shall not affect the validity or enforceability of
    1544. the remainder of the terms of this Agreement, and without further
    1545. action by the parties hereto, such provision shall be reformed to the
    1546. minimum extent necessary to make such provision valid and enforceable.

    1548. If Recipient institutes patent litigation against a Contributor with
    1549. respect to a patent applicable to software (including a cross-claim or
    1550. counterclaim in a lawsuit), then any patent licenses granted by that
    1551. Contributor to such Recipient under this Agreement shall terminate as
    1552. of the date such litigation is filed. In addition, if Recipient
    1553. institutes patent litigation against any entity (including a
    1554. cross-claim or counterclaim in a lawsuit) alleging that the Program
    1555. itself (excluding combinations of the Program with other software or
    1556. hardware) infringes such Recipient's patent(s), then such Recipient's
    1557. rights granted under Section 2(b) shall terminate as of the date such
    1558. litigation is filed.
    1559.  
    1560. All Recipient's rights under this Agreement shall terminate if it
    1561. fails to comply with any of the material terms or conditions of this
    1562. Agreement and does not cure such failure in a reasonable period of
    1563. time after becoming aware of such noncompliance. If all Recipient's
    1564. rights under this Agreement terminate, Recipient agrees to cease use
    1565. and distribution of the Program as soon as reasonably practicable.
    1566. However, Recipient's obligations under this Agreement and any licenses
    1567. granted by Recipient relating to the Program shall continue and
    1568. survive.

    1570. Everyone is permitted to copy and distribute copies of this Agreement,
    1571. but in order to avoid inconsistency the Agreement is copyrighted and
    1572. may only be modified in the following manner. The Agreement Steward
    1573. reserves the right to publish new versions (including revisions) of
    1574. this Agreement from time to time. No one other than the Agreement
    1575. Steward has the right to modify this Agreement. IBM is the initial
    1576. Agreement Steward. IBM may assign the responsibility to serve as the
    1577. Agreement Steward to a suitable separate entity. Each new version of
    1578. the Agreement will be given a distinguishing version number. The
    1579. Program (including Contributions) may always be distributed subject to
    1580. the version of the Agreement under which it was received. In addition,
    1581. after a new version of the Agreement is published, Contributor may
    1582. elect to distribute the Program (including its Contributions) under

    1584. above, Recipient receives no rights or licenses to the intellectual
    1585. property of any Contributor under this Agreement, whether expressly,

    1590. the intellectual property laws of the United States of America. No

    Lets say I am bored or crazy enough to compile the code...what do I do?

    I guess
    1) download the code and extract it
    2) download someone kind of SDK (http://developer.android.com/sdk/index.html)?
    3) Compile the code to create binaries.

    How do I test the new compiled code? Do I need to push it to Indulge somehow or there is an Android / Indulge emulator I can use (Android Emulator | Android Developers) ?

    I'm afraid not, Robert. The code they give is pretty much the basic android gpl licensed code from google that they have to release, plus one or two minor non consequential self made ones.     The source posted to Samsungs website has been updated. The new MD5 is 4a48718ba43263ea3d80e2d24f62b8ca

    Really? I guess all they updated was the MD5 name, cause it still compiles like the other one, A FAIL! Good job samsung way to fail twice in a row with an unusable source! /cheer
