i just exchanged my evo and now on the new one i dont have the top paid app tab in the market. Everything worked perfect on the other one. What i was able to figure out so far is that when i create a new gmail account everything works fine. when i sign in with my old one i'm still not getting the top paid app tab. Definately something to do with my google account but i have no idea what it could be especially that it worked yesterday. Anyone have any ideas because i really dont want to change my email address

Sounds like it is confused about what country you are in, and consequently is restricting access to paid apps not available outside the US (assuming that's where you are).

I don't know...seems to me like it must be either something in your gmail account, or something that is set up during activation of the phone...maybe your phone service provider could help?
