Can I return an Eris with 2.1 to Verizon if it's within the 30 day return period? I spoke with someone at bestbuy who told me to just send it back and I shouldn't have a problem. Sorry if this has been asked, or is a stupid question, i couldn't find a definitive answer.

I'm sure you can but what would you get to replace it? is what they will ask or is it defective?

Probably because he couldn't wait for the OTA 2.1 update, installed the hacked version and doesn't like it !

I think he should be forced to keep the phone, if that is indeed the reason !

NO you cannot. If you do happen to get away with it, when the phone goes back to factory to be sent back out as "refurbished", you will get charged the FULL amount for the phone when they go through to reset it and see what you did to it. I found this out the hard way, TODAY. The verizon guy said since I "hacked" the phone, I voided the warranty. I wanted to slap the smug off his face. I'm sure he slapped a little note on my acct. too.

i doubt you'll have a problem. i had my phone replaced after switching to 2.1 (not really because of 2.1). they didn't give me any grief at the store. and i am quite sure that they'll have no clue that it has 2.1 when they receive the return. whoever is wiping these things is unlikely to know or care about 2.1. and just as unlikely to charge my account if they did notice it had 2.1. i don't trust anything a store employee says because most of the time they really have no idea and just talk out of their asses.

You can "doubt" all you want. I was just letting the fellow know my situation, which just happened today. The verizon store employees who "dont have a clue", noticed I had 2.1 right away when he went to wipe my phone. He also said I wasn't the first person, and that he was saving me the trouble of being charged for trying to get one over on them. Even though I know as well as you do that the phone will be fine when the official update comes out. So I dont see why they care so much. But the fact remains, they do. Anyway, just wanted to give the guy a heads up from someone who has been through it.. not just speculating.

And I'm also not saying that he wont be able to get away with it. I'm just saying that I didn't.

Honestly, I'm not sure what he cleared up. Its a gamble either way. If the employee doesn't check while the phone is being wiped, then you're good to go. But if he does, or he happens to go through it, you WON'T be able to return the phone because we installed an unofficial update, and voided the warranty in the process. This isn't really a debate. Its a fact.

if they do notice it at the store and care, then i guess you've got a problem. though i'd just go to another store (unless they note the account or something). but if they don't notice and they ship you out a replacement then i think you're in the clear. some other folks on the forum have suggested that upgrading to this 2.1 leak technically shouldn't void your warranty. not really sure if that's the case.

    wow..

whatever happened to taking responsibility for your actions?

i don't care what the problem is with your phone. if you loaded the 2.1 leak, live with it.

if you had/have a problem with the phone that is unrelated...maybe you should not have loaded an unofficial OS, but returned the phone instead.

i cant help believe that everyone returning their phones is going to come back and bite ALL of us in the way of higher costs somewhere in the future.

Well in my case, I was still in the 30 day trial period, 2 weeks in, I wanted to try the Droid as the Eris wasn't powering through the programs I needed it to do. That is (was) my right to do so. Until I altered the software. Now I'm stuck with the eris, which is fine with me, but I wanted to give the Droid a go to see what its all about. If I have to have a phone for the next 18 months, I want to like it. If Verizon didn't want people to have a 30 day option, then we wouldn't have one. But we do. So get over it.

I agree. I just think the guy I got was a dick, and not very knowledgeable to begin with. Better luck to anyone else who wants to exercise their RIGHT to take back their phone within the first 30 days!

Ya once someone installs a leak os or rom on their phone manufactor warrinty is no more. However, if one was to buy the phone from bestbuy they cover that with their black tie protection. just future f.y.i.

The leak came from HTC, so its not like I "hacked" the phone. And it will update JUST FINE when the OTA comes out, so tell me.. Whats the problem with me wanting to return my phone? Its not going to cost you a dime, they just resell the phone as refurbished anyways. So I dont really know your issue is.

Is it lonely up there on your podium? Oh I see.. You have 8 posts. I smell a troll in the air...

Besides, I never said I didn't like my 2.1 Eris anyways, I do like it. I just wanted to try the Droid. Playing with it in the store just isn't the same.

I'm pretty sure you can just break the phone. If it's within 30 days, they have to take it back?

I personally don't think Verizon should give you any grief at all about returning the phone. I don't believe updating to the leak voids any warranty.

Really? You've never heard of someone changing their OS and voiding a warranty? That must be a really big rock you live under! lol, kidding of course. But I assure you, it just happened to me today. But then again, I have the worst luck in the history of humanity, so i chalk it up to that. I'm almost positive anyone else on the planet would be able to return it, except me. ;)

Edit: They did however, say that if I could roll it back to 1.5, that they would work with me. They said they'd give me a refurbished Droid, but not a new one. That kinda pissed me off to be honest. But oh well, I'm keeping my Eris and I'm happy with it. To the OP, I hope you gained some knowledge from my trial and (major) errors today!

I guess, depending on how you broke it. The guy I had today though just kept blaming everything on the "unofficial, and therefore illegal" update. He was douchetastic.

Hard to turn on a phone with water damage.
I also believe if you altered a product to where it cannot be changed back to its original condition, it is yours. Silly stuff.

Again, what does it REALLY matter if the official 2.1 update is just going to overwrite it anyways.

    Beating a dead horse...

Thanks for all the replies. I am trying to return it because im not too happy with the phone itself, before and after i installed the leaked 2.1. I also saw the droid at bestbuy advertised for $99 which is only 20 more than I paid for the Eris.

Also, If Verizon did notice the firmware, what would they do? Would I have to pay the full price of the phone?

Well, if someone comes into the store with a hacked iPhone, the genius' won't even look at it. We can't, it's a void of the warranty. If you factory reset your phone though, we can then service it.

We're not hacking out Eris', we just manually installed an update that's not official yet. We did not change the internal structure of the phone. I believe if you tried to return a rooted phone it would be more of a hassle than just having a leaked 2.1 on it...
