Does your droid do this when you touch the screen? Video inside!

Is it the "screen caving in" or is it just the "monitor portion making contact with the base"? If its the later, my replacement 39/09 did it, but my original 44/09 and my buddy's 44/09 did not. Its probably just the guides getting opened up too much during assembly.

It is the latter its just sorta annoying whenever I touch the top portion of the screen or talk on the phone during a call ill press the two pieces together and I hear that creaking noise

I doubt that anything is "broken", just not as fitted as one would like. If you're up to it, these guy's took one apart and documented the process:

I'm sure the guides can be tightened in one way or another. If not, return it, and see if you can get a later production date if its an issue.

Do you usually go around smashing together your electronics to see if they will make a noise? It's a phone with a physical keyboard so it's bound to have a little give after a time.

Is this affecting the functionality at all? Does it open and close? Does the screen work? Does the keyboard work?

If it all works I think you are being a tad picky.

I completely agree with you, but arnt all phone freaks a little picky about their devices? Especially ones that just hit the market and do have actual bugs/hardware issues that merit a exchange. I will not exchange this device due to this "defect" simply because everything else works, but I just wanted to know if it was a common issue or something unique to mine. Looking for peace of mind but not expecting it... we are all a little OCD I think when it comes to our devices thats why we are looking through a forum about our phone.

Its been documented that some phones have "loose/wobbly" screens while others don't. My original DROID, as well as the 2nd DROID on my plan (both with 44/09 mfg dates), had no gap between the monitor and keyboard, where my replacement (39/09 mfg. date) had a sizeable gap and wobbled. Given that this is a new and unproven product, his concerns aren't totally unwarranted...time will tell.

The Bad News
Over the course of using the Motorola Droid for a few days I noticed an actual (and slight) physical gap between the sliding touchscreen and QWERTY keyboard underneath. That in and of itself isn’t really a big deal – most QWERTY sliders have some space out of necessity. What was kind of irritating is the further you move from the upper right the touchscreen there is a noticeable give/bounce to it due to the space. I’m not sure I would consider this a threat to the phone’s durability, but it definitely provides an inconsistent touchscreen experience depending on which part of the touch screen you pres. It also affects the next item on our list…
