My used EVO Fiasco!

Ok so i dont feel so bad becasue it looks like im not the only one who had this happen to them. But here we go:

( I had a HTC touch pro that got destroyed so i wanted the EVO now )

So about a month and a half ago i wanted the EVO so i called the sprint stores in my area and they all were sold out. so i put my name on the waiting list. They told me that there were like 20 people ahead of me so i would have to wait. i said thats fine. Well the next day they called me and said " we have your EVO in, we bumped you to the top of the list". i was pretty excited even though i thought it was strange that they told me i was last on a huge waiting list. So i went in to the store and i looked at the new phone... i have OCD so i examined every detail. i noticed a small gash near the charging port. I told the sales man and he assured me the phone was new and that he doesnt know how that would have happened. I even asked him flat out if this is a used phone. He said no. But i needed a phone bad as i was using a crappy Sanyo loaner phone. So i took the EVO. Besides the gash everything seemed fine... untill 2 weeks later when i put the memory card that came with the EVO in. I am a I.T. guy so i checked out all the directories on the card and found some guys TAX info for a handgun and 2 porno video clips. I checked out the properties of the images and they were created in july a few weeks before i even ordered the phone! So i just realized i paid full price for a used phone and they lied to my face.
So i contacted Sprint and told them everything. They were shocked and said they will contact this sprint store and get some answers. Long story short the sprint store told me that they recived a HUGE shipment of returned EVO's and accedently gave me a returned one... BS!.n I told the sprint store: the EVO is sold out EVERYWHERE in the U.S. and you guys get a huge shipment of returned ones?? Thats Crap.

Anyway they promised me all these perks, like my money back and a new phone. But i wanted a new EVO like i paid for, so...i waited for the shipment and a week later i finally got my 2nd EVO. This one was def new however it had a defective screen!! so i retuned that one and another week later i got my 3rd EVO. Finally this ones perfect. And for all my trouble all i got was a free HDMI cable. Anyway thats my EVO story.

It was a 3rd party... even though they wore offical Sprint uniforms..lol. I live in North Idaho so theres no official Sprint stores near me.

Belive me i did everything short of calling the previous owner of the phone and telling him that Sprint resold his phone without wiping his personal data off. He could have sued

I'm not at all surprised at this story given Sprints 30 day "try it out and see" program and so many people trying to decide between the Epic and Evo. Glad you finally got a phone. I'm due for an upgrade 10/01 and I'm deciding between the two. I only hope that once I do decide, I don't get a defective one (I've read a lot of stories about this).

Wait, so, Fife, you're not surprised by this at all? Hell, your expectations of Sprint must be next to nothing! I know they're tight wads and will give you a run around if it means less money spent out of their pockets, but this case is ridiculous! They charged him full retail price for one of these, then give him a half jacked used phone instead of a new one!! I'm sorry if you feel different, but when I pay for something new, I'd be best getting something new.

If I went out to buy a new car (say a Nissan 370z, my favorite car aside from a lotus elise), paid up front in cash for it, then was handed the keys to one that had 120k miles on it and had been sitting out back, there's no way in blue shining hell I'd accept that.

I see... I understand theres no corporate stores near you, but if you can in the future... avoid 3rd party retailers. I've been with Sprint for 10 years and there is a night and day difference. I wont step foot in a 3rd party store anymore. In fact, I think they give Sprint a bad name. There is a night and day difference. Sprint corporate stores have much better service and knowledgeable reps.

I'm due for an upgrade 10/01 and I'm deciding between the two. I only hope that once I do decide, I don't get a defective one (I've read a lot of stories about this).

Me tooo! Only my upgrade is 11/01. I FEAR that I get a used phone. Hopefully with supply getting better with Sony making the SLCD screens for the EVO that I get one from that batch. I am definitely going to do the ##786# thingy to check the usage on the phone.

This may be a dumb question, but how do I know I know if its a corp. Store? On sprint.com I find all kinds of stores near me. The only problem is they say sprint by nuwave or sprint by digicel? Are those stores considered 3rd party or are they the real deal? There's one in a differet city that just says sprint. Sorry if this is a dumb question...
