I am looking to purchase a samsung nexus S from bestbuy. To get the rebate on the phone, I would need to upgrade to the 2 year plan with the 10$ a month data plan. Lets say I go ahead and do that and after receiving my rebate $ on the phone I change my plan back to how it was previously (without any data plan). What would stop me from being able to do that??

You need a data plan on all contract smart phones according to TMobile. If you buy the phone outright, and otherwise use Even More+ you can use your own wifi. BUT YOU CAN'T GET A SUBSIDIZED PHONE!!! Some prepaid plans will also let you do that. You will have to talk to a human to get the information. Too many people saw the cheaper EM plans, switched, then found out they could not upgrade their phones at the discount price and caused problems since they didn't read or believe the rules of the plans.I have TM service and read their help forums. I buy my own phones.

I am looking to get a smartphone without data plan because I do not wish to pay for internet when I am in wifi areas 90% of the day. I have TM service also. What do you mean by you can't get a subsidized phone and what is even more +. All I want to know is if i purchase a nexus s or any other smartphone outright, (given that it is unlocked or t-mobile compatible) will I be able to just slip my sim card in and go?

TMobile introduced those plans last fall. They are cheaper.
A subsidized phone is one of the "get the G2 for $49." type deals. Those require a contract and data plan.
Even more plus is a postpaid account that requires you to buy your phone outright from TMobile or elsewhere. You don't do monthly payments on the phone.
You can only get the EM+ from a store. You can't do it over the internet via TM website. You might be able to get a reply from customer service.
I have that plan and I like it -

You should be able to use whatever you are now paying for.Just make sure you can turn the TM data off.
