They reused gpl code without releasing the code as demanded by the gpl license. add ons don't have to be given, but the modified kernel source code is supposed to be released. Keeping it closed source is a violations of the terms of the general public license (gpl). At least I think that's what it is...

Yes. They released the source, it's just horribly broken and cannot generate anything working, and thus anything identical to what's released in the stock kernel binary.
