Wouldn't Google have to make money off the software to sue them? They make money from searches and the market not the operating system. Also I thought Java was open source software or at least most of it was.

I am sure it will go away when Google throws some cash at them.

You know, there's seriously been a massive level of backlash for Google since releasing Android. If it's not Apple, then it's some fly-by-night patent holding douchebags, if it's not them, then it's Oracle. As Android continues to gain strength, there seems to be this continual need to sue them. In time I imagine we'll determine whether these lawsuits were legitimate, but for now it seems like everyone wants a slice of the Android pie and the consumers will lose out the most from it. I don't think I'd buy a product from Apple or Oracle with their sort of behavior.

Now, there hasn't been any final court ruling, so it seems. But supposedly a "unbiased" expert agrees that copyright infringement is indeed what happened and compensation is necessary.

Now, my question is...
1. what did Google "take" from Java?
2. I assume whatever Google got, it was "open source" code and they just redeveloped it into Android... is that what it is?

in addition... since Android is part of the OAI... can you sue off something that is "open-access"?

Oracle has a lot of claims here, including license violations (running full Java on a portable device), using parts of Java that are not open source (the test suites), and violating numerous patents. You can see a pretty good breakdown of the claims at Groklaw.

Even if Google is guilty, Android is too ubiquitous at this point to shut it down. Google stand to make over a billion dollars over the next few years from Android. They'll either license or pay out a fine, or both. Oracle will get their money and that will be the end of it.

I think Google uses Oracle databases and business software. So the first thing Google ought to do is dump their Oracle databases and business software.

If you happen to notice Google's excellent legal time is gradually peeling away and vaporizing Oracle's claims. Oracle's claims are still there but they have been greatly reduced by the courts.

I suspect Oracle is in the losing end. Ironically Google knows more about Java than Oracle.

A bit of ironical fact:

The leader for software development for Sun Microsystem when Java was made was none other than... Eric Schmidt.

Yup, that Eric Schmidt. He practically led Sun's software engineering efforts from 1983 to 1997. During which Java was created. It was his brilliant career with Sun that made Eric Schmidt the choice for CEO for a startup called Google.

Which brings us to the second point.

The father of Java, Dr. James Gosling, now works for Google. As you guess, he worked in Sun Microsystems from 1984, and finally left Oracle in 2010 after he got fed up with Oracle.

In fact, one of the patents Oracle is suing Google with happens to be Gosling's.

I predict that Google will successfully contest most, but not all, of Oracle's patent claims. At that point serious negotiations will begin and they'll come to some kind of agreement. As Drhyde said, there's too much invested in Android to let it die. Oracle doesn't want to kill it - they just want part of the revenue stream.

Personally, Oracle should just sell off the entire Java franchise and IP to Google and Google should accept buying that.
