As i never pressed any buttons they are still trying to con me out of my money

They have screen shots? lol How is that even possible? File a claim with your credit card, you'll get faster result. I haven't heard the best reviews for Google Checkout support tbh. Don't forget to unsubscribe to whatever they subscribe you to!

^I'm guessing they were "informational/explanatory" screenshots, not screens as evidence of his use of the app. :D

Google Checkout support themselves wont care, but they will forward the complaint to the dev, and devs have very, very few complaints until the account gets pulled. So they will often honor any legit complaint with a refund when the alternative is possibly getting their account shut down.

It may work, it may not. Personally I tend to give refunds pretty liberally. I want happy customers, because then they are happy supporters and promoters of my app :)

I still say file a fraud claim with the credit card company  I believe it's a much faster route, lol.

Except if I'm reading the OP correctly. it was charged to his phone account not to his credit card. It would need to go through his carrier rather than credit card.
Phone account = Google Account. I read it as it's through Google Checkout, which requires your credit card for you to make any app purchases and in app purchases.
