Went to verizon about the 3rd time and everytime i get a new phone so today i told the tech that im fed up with these Sorry A** HTC Eris phones i've had 3 of them and this one i just got to hours ago. he said well maybe you just need a software update and i said unless your are going to give me 2.1 dont tell me that i need one. when the lady tech did the update and had me sitting in the store for 2 hours. i then said that i want the Moto Droid or the palm pre he then said that okay we can make that happen it will be 155 dollars and i said where did the extra 30 somethin dollars come from and he said from the restocking fee and then i said so wait yall restock broken phones and he said ne but we have to restock it and charge you then i said wait you dont restock broken phones yall send them off he then replied i know but we still have to charge you a restocking fee. A** WHOLE VERIZON REPS
 
My Moto Droid completely froze and the Verizon reps couldn't get it working. They were going to replace it for me, but I told them I was done with Motorola. Since the phone was defective, they let me switch to the Eris without a restocking fee. In fact, they had to credit me the $100 difference. They also credited me the case, screen protectors, and let me keep the 16g sd card.

I think you just had a "by the book" Verizon rep.

You might also want to call Verizon instead of going to the store. I've always had a better experience, but out here good customer service is rare.

I've had better experience by calling Verizon instead of using a store. I'm not 100% sure, but it seems to me that Verizon has officially licensed Verizon stores that carry nothing but Verizon products and then they have associate stores that carry Verizon phones and offbrand accessories. Depending on which kind of store you use you get different policies.

I'm assuming you were out of your 30 day return policy ?

A. they have the right to give you a refurbished phone, they don't have to get a new one out of the box for you
B. it's in your contract
C. try buying something at best buy, 15% restocking fee (on some items) even if you return it within your return window

Nope i idnt even make to 15 days and even if i did i brought the $2.00 extended warranty and the $7.00 insurance so it didnt matter i was going to recieve a new phone either way...

Ohh and my 4th phone when charging. The screen wont go off so it takes almost a day to charge does anybody no if that is in the menu or will i have to try a hard reset doesnt matter if i have to do one since i dont have any apps and my contacts are backed up on google :D

Edited: and it drops calls like im on AT&T. but i have all 4 bars and i know its not the other person because when my phone hangs up it makes the bee sound and yes i've already called *228. doesnt help at all

I ordered the phone on the internet. So i got my Eris was $80 and that seemed like a good bet. Guess i shouldnt have been so cheap and went for the Moto Droid cuz this is horrible...

Ohhh can i cancel my contract because of this. because i want to go back to Sprint so i can get that sexy hero :p

Also, sounds like you were too busy raging to actually work out your problems. Out of the problems you listed, there are several reasons they could be happening, and ways to fix them.

Also, any replacement phone comes with the original OS install and none of the OTA updates (well, mine didn't and I'm on my 3rd phone). There are a lot of software fixes in those updates, but like I said, you were to busy nerd raging to care about how to fix your problems, only that it didn't work the way you wanted the first time.

Welcome to the real world, and not the McDonalds playpen.

Dude look they were hardware issues even htc said it themselves and i had the latest update on it because that is one of the first things that you do after activating the phone my step dad has the hero since it came out and had no problems so i dont know what you are talkkin bout

The Hero and the Eris are the same HTC phone rebranded. This site has a forum for the Hero and you can see the kinds of problems that are had with that phone. The more complex you make something the more things that can go wrong.

Out here, we have Verizon stores that sell everything Verizon, even the FiOS stuff, but I just hate going in there. I still call the 1800 number and they ship me whatever I need. Sure you have to wait until the next day to get a phone, but you're not in the store with those guys.

I think that it's just that there are so many people coming into the store, they don't mind annoying a small fraction they can get the majority of the customers out the door quickly. If you have a problem with your phone and need them to look at it, you've just jettisoned yourself to the 6th layer of Hell. It's those numbers that encourage me to just call the 1800 number.

Same phones. I got my Hero a few weeks ago and have been reading all I can about it. A few days ago my brother told me he was getting the Eris so I started reading about it, one of the reviews I read actually said " read our review of the Sprint Hero, it's the same phone ". Good thing is, we get a cheaper plan at Sprint though:D
