***Official HTC Incredible Thread***

this photo was upload on Feb 23 by ADR6300. This is the 2nd photo of monitor that I have seen Skype on it. Also, there is a Legend excel icon on there and apple at bottom. If picture has already been posted then saying sorry in advance.
Nice. However, I don't think either icons carry any significance.

Skype is very popular in Asia as it is a cheap way to communicate with others, especially those with children who are in college. College in places like China are very competitive, and most students are forced to go to other countries. Skype, in this case, would be ideal.

As far as the Apple icon, I'm assuming maybe thats like Itunes or something?

Only thing that might have some lead is that excel file titled "Legend" but that is a bit vague.

I even went as far as googling the "Careful what you think" wallpaper, and found this:

Actually, the way that cases sometimes proceed, Apple can file for a temporary restraining order against HTC for them to cease and desist all activities until a judge makes a ruling on whether or not there is enough merit for a preliminary injunction to occur. Although filed at the same time, they are actually separate rulings depending on the State in which it was filed.

I currently work in the biotech/pharma sector, and this stuff happens all the time when it comes to patent expiry of products. I'm not sure how the courts will treat the tech industry as compared with the biotech/pharma industry, and my disclaimer is that my pre-law degree obviously doesn't constitute being an "expert" but to have just enough knowledge to be dangerous.

Here's a pertinent example: a generic manufacturer produces an identical or virtually identical molecule to what has been patented originally. Most of the time this is in anticipation to patent expiry. However, many times foreign manufacturers try to sneak in these identical products on to the market before the original patents expire. The holder of the patents file a suit similar to what Apple is trying to do. They will then request a temporary restraining order which prohibits the any manufacturing or distribution of the product in question. If a TRO is granted, there is a set amount of time that the courts set to respond in order to vacate the TRO by providing additional evidence that they did not infringe on the original patent.

I tried to be as brief as possible, and this is obviously a worst-case scenario. But if there is merit to the claims, and the courts think likewise, there is the legal possibilty that this can occur - and there has been precedence.

Of course, the courts can also send it into arbitration and avoid all of this.

I certainly agree that it is possible for Apple to seek, and maybe even get a preliminary injunction; I just think it's highly unlikely that one would be granted if sought.

With respect to a TRO, I 'm pretty sure that there still has to be some type of hearing during which the elements of success on the merits and irreparable harm are addressed; it would make no sense to issue a TRO if the likelihood of success on the preliminary injunction was nonexistent.

In the scenario you present, the foreign drug manufacturers that are in the business of sneaking drugs that are violative of another company's patent portfolio onto the US market are often times difficult for the courts to gain jurisdiction over since they typically have minimal contacts with the US. Thus, a monetary judgment after the fact would be nearly impossible to enforce, rendering the harm caused by the infringement (i.e., the stealing of business) irreparable. Additionally, there are questions of public health and safety when it comes to the import of foreign drugs which simply do not exist in the Apple/HTC situation. Here, HTC is a viable company with corporate offices in the US making a monetary judgment relatively easy to enforce.

So, it is definitely possible for Apple to pursue and gain a preliminary injunction if it can establish its claims, I just don

This might seem random but the phone in that pic just might be the HTC Paradise (which we have heard next to nothing about except that it has a QWERTY)....

The red/orange back might mean it is coming to Verizon like the backing on the Incredible. The Paradise probably be priced around the Devour.

Ok well your original picture did not include that portion. However, i find it weird that a work computer would have that wallpaper, instead of something maybe more.. professional? I dunno though.. either one of us coulld be right since neither of us have proof.

Have you try searching that website for pics or video taken by the ADR6300.
Nope. That site was just linked to the wallpaper that was in the photo you posted. Those drawings are just random drawings.. nothing phone-related

Actually, the more I come across images of prototypes and testers, I'm noticing that red color more often - either fully exposed as on the Incredible or partially exposed as on the Desire and Supersonic (maybe?). I don't think this is coincidental. I'm thinking, like others have mentioned before, that "unofficial" versions of phones may be issued with visual markers so that they are easily identifiable as testers.

Either that, or someone at HTC is really in love with the color red.
