I emailed htc after quarter one was officially over about 2.1, even though I am on leak 2, this was the response.

I understand you are interested in the update coming for your Droid Eris. While it has been announced that the Eris will be receiving an update to Android 2.1 with HTC Sense in early 2010, the exact date of when it will be available has not been announced yet. The latest information we have heard from Verizon indicates that the update is due to be released in the earlier part of the 2nd quarter, although no specific date has been set yet. The original statement was that we had projected the update to be available in the 1st quarter; however, this did not come to fruition. Thank you for your patience in this matter. "We" have? Were you promised an update when you purchased your phone? Does it work exactly the way it did the first day you owned it?

I seriously do not understand this entitlement philosophy that some of you have as though HTC/Verizon somehow OWES you an update.

Actually yes. I was explicitly told when I purchased the Eris that it would "shortly" be updated OTA with version 2.0 or better. So on the basis of that verbal contract then, yes, I am owed an update.

I'm finding several. What was the size of the file you downloaded? Do I just put it on the sd card and launch it?

This is a new way for me.

It was 1 to 2 mb. Yup just put it on your sd card and run it with astro. It may not work for you though cuz it may log in with your google account and know you never purchased it like I did. Not sure...

Shortly. Did the sales person define shortly? If not, your "verbal contract" means nothing. If you receive it sometime in 2010, as I suspect you/we will, then you may be receiving it within the time to which said sales person was referring.

No argument. I wasn't saying the contract was abrogated. The question that was asked was why do some people think they are owed an upgrade. My answer is we feel owed an upgrade because at time of purchase we were told an upgrade was forthcoming. We aren't owed an upgrade because we feel entitled, we are owed an upgrade because Verizon personnel used said upgrade as a tool to sell the phone.

Lets say you were dating again. You have this nice girl who you love and you're going out. You ask her "have you been knobbing my friend?"

She says, "of course not, we're getting married. I would never cheat on you."

You come home one day and she's knobbing your brother.

Verbal agreement? Right? She'll weasel out and say, " It wasn't your friend like you asked, was it?"

Pretty shitty deal, right? She isn't required by law to stay faithful. It'd be nice if she did, though, right?

"Promised" is the wrong word to use, but what would you call the Twitter messages from HTC or VZW that everyone keeps quoting? It's "something" isn't it?

By your logic, Toyota shouldn't have recalls for faulty pedals.

"Oh, you unintentionally accelerated into a nursery full of newborns, through a wall and into a pet store with puppies, and then through a gymnasium wall full of high school graduates? Sod off, you aren't entitled to anything."

If you are sold a phone that has flaws, is it your fault? If it is, why are there patches that are released OTA? IF said patches are included in the package of a 2.1 update, does that change anything?

The Eris hasn't had anything huge happen to it, but what if you owned a Nexus One and the 3G pooped out every so often? Then would you be fine stuck with a shoddy device?

I was told two to three weeks back when I got my phone in december. I dont understand why people get mad at us wanting our update, which was one of the reasons I bought the phone to begin with.

Also, there was more than a verbal contact from htc, the promise of an update in quarter
one was an official announcement.

It was one of the questions I explicitly asked. I knew when I bought it that the OS was old. I asked was it upgradeable and in the conversation with the Verizon employee he was fully aware that not being able to upgrade would have been a deal breaker. He clearly said that yes the OS would be upgraded. Now, I'm not really upset (Yet) that I haven't gotten it, but if a representative of a company (any company, not just Verizon) makes a promise in order to make a sale, then they are obligated to follow through. If I hadn't been told at point of sale it was coming, then I wouldn't feel that I deserve it. I'd still like to have it, but I wouldn't feel Verizon was obligated. But since they did (through their proxy---the sales person) used it to sell the phone, then I do feel they are obligated to me now.

shortly is not a period of time that can be measured, how long is it? And this was told to you by a person on the bottom of the totem pole. At least they didn't lie by giving you a date that wasn't met.

Who did you buy the phone from? HTC completed the upgrade in Q1. VZW has not released it and I do not recall them ever promising a date.

And they still are going to upgrade it, so why get upset.

I already said I had no argument with the assertion that the period defined by "shortly" is not yet up. I even said I'm not upset by not having it (YET). It's irrelevant the level of the employee. He made a promise on behalf of Verizon. I didn't say that they have lied, or even that they don't intend on fulfilling the promise. I happen to believe the will, they are just delayed. That's not my issue. My issue was to respond to the question of why I feel like I'm (and others) owed an upgrade. The answer to that is I'm owed an upgrade because Verizon's representative said it would get one. Period. If they hadn't said that, then I wouldn't expect it. BUT absolutely. If the sales person had said when asked that the Eris would remain on 1.5 forever I would not have purchased it. I would have waited for something else.

Do I feel I'm owed an upgrade? YES. ABSOLUTELY. But, I'm only owed one because Verizon used the upcoming upgrade as a tool to sell the phone. If they hadn't done so, or even simply said they didn't know if it could be upgraded, then they wouldn't owe me squat.

Do I feel they are "lying" because of the delay? Nope. Not at all. OS changes take time, and I've been with Verizon over 10 years and in that time I've found them to be VERY slow on releasing anything new, whether an update or a phone. I have no problem with this, I simply feel they are more thorough.
