Upgrading/Transferring phone question

Here is my situation. I am not eligible for an upgrade because I just recently got a new phone due to mine being out of commission. My wife however is eligible for an upgrade. I plan on going to Best Buy and buying the Hero with her upgrade eligibility for 179.99 and then transferring it over to my name and transferring her current phone back to her name. Since Best Buy doesn't have mail in rebates this shouldn't be a problem, right?

Thank you for posting an update that you spoke with a rep that said that it wouldn't be a problem. I hope this is the case for me, as well, since it seems that it varies from rep to rep. Unfortunately, I have to wait until the 15th for mine, as the person with upgrade eligibility on my account works offshore and won't be back until then! :(
