Where can i buy this phone when not upgrading?

You could pre-order it at full retail price directly from the website if you really wanted to.
+1 Yup - I'm ashamed to admit I've done exactly this. More than once. You'll get a message that you aren't eligible for an upgrade, but can buy the phone at full price. If you turn your PC speakers up all the way when you submit your order, you can actually hear the Verizon guy from the commercials whisper "sucker" when you submit your order.

You'd be better off paying the early termination. Depending on how long you've had the phone it will probably be about $300 bucks or so. Then you can get the Incredible at the 2 yr price $199 after 100 instant rebate online or $269 for 1 yr contract after rebate online. Then you can sell the eris outright.

You're forgetting the $35 activation fee that Verizon would charge a new customer 300+199 = 499 + 35 = 534 which is more than it would cost him to just buy the phone. Not to mention I believe ETF would also cost him his phone number.
