No wifi, no update

I do not have wifi. I'm not ambulatory to the city Home Depot to update my OS. I'd really like the security updates. I have an unlimited data plan. I'd like to hear from any attorneys on here - Can i sue Google if my phone gets compromised by hackers after a security update is available but Google wouldn't allow an update to occur using my unlimited data plan?

first off hackers cannot hack your phone like you think. in order to get hacked they would need permission to gain access to your system files.....in other words, they would need to root your phone. for this to happen, they would need physical access to your phone and access to a computer along with adb software installed.

if anything what could happen without security patches would be your identity could be stolen. or at a bare minimum, your phone number or address could be added to robocall lists.

why can't you go to Starbucks or some coffee shop that has wifi access.....it should be fine installing updates that way.

not sure i understand how Home Depot plays into all of this.

I believe that that might be carrier specific, did you buy your phone from a carriers phone store? This is probably something flashed into the oem portion to avoid a zillion people's phones from downloading huge size updates through cell towers all at the same time the second an update becomes available. I know that on mine, there's an option in the settings > system updates that says, "download system updates over wifi only", and it is a non carrier specific unlocked phone, so it may be your carrier you want to sue, rather than Google.

Well unless you got a Google Pixel device, it's much more likely you'll need to sue the whatever it is manufacturer of your particular phone or tablet, and/or your carrier. Of course Google itself doesn't know about your particular "unlimited" data plan. Unless you're using Google Fi as your carrier that is?

FWIW every phone I've had, like Samsung, Lenovo, Oppo, and Huawei, has been able to download and update using carrier data, and not WiFi.

You can turn that off somewhere in Settings.
I believe the intent was to save you money on data. Damn I'm old.

Depends on your data and wifi. My LTE, indoors, will do 120-130 Mbps at home. My WiFi is faster than that, but many people's is significantly slower.

As for suing, I'm not American so find this idea that the solution to every problem is to enrich a bunch of lawyers a rather curious cultural tradition . But nobody can give an answer to your question anyway, because it would depend on the nature of the "hack" and whether it was anything to do with your inability to install a patch that would have prevented it (if there was no such patch you have no case). So unless you knew exactly how it happened no honest lawyer who understood what you were asking could say whether you had a case or not.

You sue someone because they did you wrong; that lawyers get a cut is a process. Kind of like how the USA told the king of Britain to eff off, someone will get rich, and someone else will get spanked.

Yeah, it's just that like there are national stereotypes for all countries, one for the USA (as seen by the rest of the world) is the tendency to use lawsuits as a first resort, and the number of frivolous lawsuits that are generated by this. "American tries to sue for <something absurd>" is a standard "light news" trope over here (of course they don't bother reporting that most of these lawsuits are thrown out almost immediately, because there's no interest or amusement in that follow-up story).

And yes, it's a national stereotype, but having once heard an argument between 2 7 year olds in San Francisco end with one of them threatening to sue the other I can't help feeling that maybe there is an element of truth behind it .

Back to the original question. No you cannot sue.

Try this:
Settings>Connections>Data Usage and turn on Mobile data only apps.
