Financing the suit? (Possible Solution)

It will, however, take considerable effort on the part of the lead plaintiff to find representation and they also must be willing to participate in an legal proceedings should the case go to court.

So how many would step up and help officially represent this case?

This case needs experts that will go on the record to say that the phone has the hardware to support the 2.0 update.

Also, couldn't we surpena the 2.0 os to see if it is possible to make it run on the phone?

I have the number to an attorney that deals with class act suits.

If you are that interested in persuing it I would suggest you call the lawyer and if there is a case he will get the "experts" needed. You are trying to put the cart before the horse here. You need representation first.

I guess I will stop by a pal of mine to ask a few questions. I mean I do work in a law office, we just dont do class act lawsuits.

*Deep breath*

I will try my best to get info

Just wait for the Slide, call TMobile and demand a free exchange. If you can make your way to their customer service department, there's a good chance you'll succeed. I'm ready to leave Samsung out to dry just like they've left us.

Well I understand that I can wait and also everyone else can that are getting close to updating their phone, but as I went to look at Tmobile.com, I see that they are still selling the Behold II for 149.00 with a free car charger.

The people who sign up for a 2 year contract dont deserve to go through what we went through.

I am going to see if I can do something for them because when they finally realize that wtf? my phone is 1.5? when am i suppose to get an update?
then it will be too late for them.

If we want to get justice, we are at the juiciest time to do it now.

They wont give me the andoid 3g slide,

they will give me the android 3g at a full discount rate, but I literally had to tell them that in order for them to "investigate the offer"

....nope, they told me that they couldn't do it. The best they could do is a partial update for 319.00.

That freaking sucks because I could have bought the mytouch3g at 140 if I still had my full upgrade.

Do I need to call the cancellation department?

Guys,

My brother is an Attorney. I will talk to him this weekend. What we need to know is if the hardware is capable of being upgraded beyond 1.6

Samsung claims it cannot be upgraded beyond 1.6, and they may be correct, because the 2.0 claim was probably made before Google released 2.0. Is there ANYTHING (other than Money) that is preventing Samsung from releasing a 2.x for the Behold II?

How about the fact that the Droid Eris/Sprint Hero are Less powerful spec wise and have been Successfully updated!

Ask your brother if there is any way we can surpeona the source code for the 2.0 operating systems and have a computer engineer that specializes in Android programming, look at them and tell whether the phone can support it running on it.

A computer engineer might also be needed

2.0 was released in October 2009. The BH2 dropped in November. And even if something about the hardware was fundamentally incompatible with 2.0, are we supposed to believe it took them 6+ months to figure that out?

And I'm not buying there claim for a second. 2.0/2.1 run the Kernel as 1.6, and by the way, we KNOW 2.1 runs on the BH2, it's just not usable without the proprietary drivers/etc. And remember that the G1 has a functioning 2.1 rom.

On a related note, does anyone know what proc chipset the BH2 has?

Everyone is talking about getting a replacement phone. I wish Samsung just update the software, I don't want the MT Slide. I really like the BH2 hardware, it's possibly the most compact Android on the market, and I like all the hard buttons. That's why I got it in the first place.

I agree, just give us the support we paid for and you [Samsung] promised.

And I just have to ask, you like ALL the hard buttons...even the cube?

They are going to say that 2.0 was an private release for the Motorola Droid and it never dropped in AOSP, therefore they never had access to the code... then when 2.1 came out, they realized that it wouldn't run on their hardware... (i'm just saying what they are going to say...)

Well the Droid can have its dang 2.0.

Samsung can give us either 1.999, or 2.01

And if 2.0 is exclusively for Droid, is that forever? Or is that temporary?

If Droid gets an update to 2.2, or 2.3, or even 2.5 later on, doesn't that mean that behold II users can get 2.0.

I mean think about 2.0 as a shell. Doesn't the crab go to a bigger and better shell and doesn't care about the older one?

Are the Motorola people really going to fight Samsung and say, "NO! YOU CANT HAVE 2.0 BECAUSE THE DROID USERS NEED TO HAVE THE OPTION TO COME BACK TO A WORSER UPDATE!"

I run Eugene's ROM with no TW, so I never use the Cube button. But I do like the D-pad over a trackball and I like the physical Send/End buttons.

Rooted wise I like the cube button cause it has been formatted to trigger search feature. So the only thing left is a little picture and if a little picture is bothering you then wow.
