Radio Shack replacement phone worse

I picked up my phone on launch day, version 2 hw. I was having a bit of the grounding issue, but the big problem was light leakage onto the screen. The whole bottom of the screen was brighter than the top. And the headphone port was junk. So I finally got my replacement yesterday, hoping to get a better phone. I turn it on, and its still a version 2 hardware. Looks good though as I played with it throughout the day.

This morning I had some time to really look at it, and noticed a bunch of problems. The battery cover does not fit properly, the whole right side doesnt click in. It's literally just hanging there and has fallen off twice already. The grounding issue is bad on this phone, it wont even work in my gps holder in my car. And I am getting serious light leakage on the bottom of the phone now. I can literally stick my whole fingernail in between the bottom of the screen and the bezel.

So what should I do here? Should I just try to get another replacement from RS and HOPE it works better? Or should I try to complain to Sprint about it? Sprint already told me they cant do anything yet since its within the 30 day purchase period. I really dont have time to be running back and forth to RS all week waiting for a replacement.
 
But like I said, I already went into a Sprint store, and called CS when trying to get this replacement, since RS took 2 weeks to get it. They both told me they cant do anything within the 30 days. And I dont want to wait til the 30 days is up, then go to sprint and get a Refurbished phone.

My second Radio Shack phone also failed and again no stock. I called the Sprint store with service center and they RELUCTANTLY ordered me a replacement. I picked it up last night and it is a service unit no retail box battery SD card etc. It came in a small box with only the battery door wrapped in bubble wrap. I was assured that it was not a refurb but what they call a service replacement unit. It is a hardware build 3 it did have the newer battery door and I did a ##786# and indeed it is new with no minutes on the master clock or referb information in the service memory. So far so good. Right now the tech said the service units will be new because the handset is so new they have not had any time to fix any returned ones yet.

The life timer will always be cleared when you get a refurb, since they clear the memory and reflash the os.

I really dont trust that. If it is brand new, why wouldn't it come in a retail box? I've been through my share of refurbs in the past, and a phone wrapped in bubble wrap with no battery is a refurb.

The handset's with build #3 have only been out three weeks at best, no way it could be purchased then used then returned then repaired and sent out again in that amount of time. In fact they got this handset last Friday for me 2 weeks after launch impossibe for it to be a refurb. Sprint got this unit in for me to replace my first one then on the same day Radio Shack called and said they had one for me also so I went to Radio Shack and got it but that one proved to be defective with the lower key lights staying on in sleep mode. I got lucky Sprint was still holding this one for me.

I have to argue with this point. While the life timer may or may not be reset (i can't remember), the manufacturer is required by law to change the status of the phone to refurbished. So checking with ##786 will indeed tell you if the phone is refurbished or not.

New ROM and flashed software cannot and does not change this.

probably can be reset. if you go into ##786#, hit menu and there's a rest button which ask for a password. as long as you have the password i'm sure there's some menus in there that allows changes

My Advice....Return it and get a refund! Then start all over again with either Best Buy or Sprint....My Local Sprint stores have stock, and Best Buy is said to start receiving shipments this weekend, so that's a good sign... I will never trust Radio Shack again. I returned my first unit to them on launch day because it was having some major issues, and they sold it to another customer later that day after they refunded me. Big Thumbs down to that store in the BK...
