Data is not guaranteed

I just got the Evo last week and since the first day I have been getting an error 67. I have been in contact several times with Sprint customer care (you can get more details in my post in this thread )and the last thing that I was told was. On a roaming tower, which I am on when I am at work, data is not guaranteed.

Now I just have a few questions...

Is it because of CDMA? I mean, do the GSM networks in my area have a conflict with sending data to a CDMA phone?

Is it due to not having 3g coverage? I know with my past phones if a 3g connection was not available it would revert back to an EDGE connection. Can the EVO do that?

Or is it because of some contract dispute that the roaming towers won't let the data traffic threw?

Seeing how most of the time I will be in a roaming area I would like to know if there is a light at the end of this tunnel, or will I just not be able to depend on my data connection.
 
AFAIK there is no unlimited roaming option. it's limited to like 300mb roaming per month. GSM and CDMA networks are incompatible. It's like trying to stick a blu ray into a cd player, just won't work. That being said, switch from sprint if your on constant roaming.

I beleive I have read everything and I do not see where roaming data is limited to 300mb. Actually I find that the only limiting going on is with mobile broadband cards not smartphones.

Here's the excerpt pertaining directly to our discussion.

Off-network Roaming: The primary use of your Device must be for domestic purposes within the Sprint-owned network. Domestic means use in the 50 United States and U.S. Territories (except Guam). Sprint reserves the right, without notice, to deny, terminate, modify, disconnect or suspend service if off-network usage in a month exceeds: (1) voice: 800 min. or a majority of minutes; or (2) data: 300 megabytes or a majority of kilobytes. The display on your device may not always be on and will not indicate whether you will incur roaming charges. You can monitor usage online through My Account. Roaming is not available with single-band phones, or to customers who reside or whose primary use is outside an area covered by the Nationwide Sprint Network. Sprint may limit or terminate service if you move outside of the Sprint owned-network.

Well I'm not going to worry about it too much seeing how 99% of the time I am roaming I just plane can't connect.

I from what I have read even though they have lowered the roaming data cap not many have been charged when they are on the Everything 1500 plan , which I am on.
