Was sold a used phone... Need some advise.

Where did I make a terrorist threat? I said to call news agencies not bomb the place. People call news agencies when the company won't fix a problem all the time. Why would I be arrested?

I never said to threaten anyone I said to raise hell that he was sold a used phone and was told it was new.

I agree, you didn't make any terrorist remarks. That posting accusing you of that is just plain stupid, and bad, bad advice. Your posting was OK.

I would definitely contact a store manager or the district manager as someone else said. And remember you get more with honey than you do vinegar. I would be totally upset if I just shelled out $199 plus tax, etc., for an EVO to see that it was used. BUT I would've refused the phone in the first place when the rep gave it to me. I know when I go to the Sprint store on November 1st to upgrade from my P.O.S. BlackBerry 8330 to the EVO, I'm going to tell the guy that I (me, NOT him) want to open the box and unwrap the phone myself. Let me ask you this: Did the rep pull off the screen protector with the quick start steps in front of you? He should've, and that should've been your queue to not take the phone in the first place.

...I ended up buying an Evo last week...

I did a ##786# and realized the phone had almost a thousand minutes on it already, and was activated on the 7th of July!


My 30 days are running out, and the rebate eligibility expires on the 11th. I already ported my number over.


Having trouble with the time line but you still have 2 weeks or so...use that time to find a phone at bestbuy, radio shack, sam's, etc. Return the original purchase and take the commission away from the person who did wrong by you.

Okay this might suck but this is what I'd do. Find someone to give you a free gsm phone for like tmobile or buy a Prepaid kit for $6.99 port your number over and take the EVO back to sprint. Go back to sprint buy a new EVO and get a new 30 days to review it. If after 30 days you like it port your number back.

At the least this will be a FREE process at the most it will cost you like $30.

No, I did not see him pull the original plastics off the phone. I didn't know such a thing existed.

I didn't figure out the thing was open box until I left the place and was on my way to work. I did find it odd that he said "Yeah I might have one in the back if you're ready to do this today"...........


It's my fault I have this phone, and I know that, and I know better, seeing how I'm in retail electronics and I just know better.....but for Christ's sake, I've been trying to get one of these effing phones for weeks.....I was blind.

This has become almost certainly my resolution. Take it in to my own hands to resolve, and end up saving a lot of cash too.

I hope it doesn't come to this, but I'll do it.

I wish you the best of luck. Push come to shove I'd just return the phone and get a full refund, then tell off the guy that sold it to you. At the end of the day it's just a phone and you can always get another as soon as they're available. See if you can even pick up the Epic 4G and return it within the 30 days when they get more EVOs in stock.

So I went into the sprint store today to get a replacement phone that I was promised a while ago, but couldnt get because they were out of stock. The guy goes to the back and gets what looks to be a new phone. But I noticed there was red marker all over the UPC and esn stickers on the phone and on the box. Kind of wierd I thought, but everything looked new. When I left, I did a ##786# and found the phone was activated on 8-10, had over 1000 calls, and was NOT refurbished. So now I am in the same boat, Sprint gave me a USED phone.

Last night, I replied to a customer service quality assurance e-mail that the last guy I talked to sent me. I told him I still didn't have a resolution.

Today, I called the Sprint Store JUST as they were opening the boxes for their delivery. One Evo arrived. Broke some speed limits, etc. Made it, bought it. Added it to the account. Told the guy what was goin on, he couldn't believe it. I paid retail for the phone, just like the first one never happened.

Ironically, as I'm walking out the door, the customer service rep I replied to called me. I told him I had a new phone. He swapped the numbers on the phone, and canceled the original phone.

My new Evo is a 0003 made on 7/10 with an Epson screen.

Tomorrow I will return the original phone, and chew someones ass. Now that I don't need them for anything, I don't mind to light in to someone. I already asked for the district manager's contact information. I know better than to scream at the one person willing to help me, but now these guys have nothing I need.

Especially after I found out this is a Touch Pro2 battery, which after testing the new phone versus the old one, is significantly worse!

So if all goes well tomorrow, I'll let ya'll know. Thanks for all the tips.

I totally understand. U get all excited to get something and then once the excitement dies down and u check out the new gadget ur like WTF? Happens to me too so I know exactly what u went through.

Happened to me once. I found out because there were some really bad pictures, so bad in fact that I called the cops and they confescated the phone. I had to fight with the store for a replacement. The manager badgered me every day for the other phone back. The police were really helpful and they went personally to the manager and explained that they weren't getting it until their invetigation was over. *note it wasn't a corporate store.

OK, an update on my situation. Went back to the store today and talked with a manager. He looked up the phone's esn, and saw it was returned a few days ago. AND the lady who returned it just so happened to swap this evo for another, meaning it was obviously swapped out for a defect, why else would you do a swap. He says he will call his district manager and see what they can do. A few minutes later, he comes back and says there is nothing wrong with the phone, and that the lady returned it and cancelled her service. I called him out, because he just told be she swapped it out. He tells me that their in house techs refurbished it, which is why it doesnt say "refurbished" on the phone. Well, if they really did refurbish it, by law it has to say "refurbished". He told me there was nothing they could do, so I left before I got too angry.

I get home and get ahold of someone at sprint's "executive office". She tells me that I dont know what I'm talking about, and accused me of trying to fraud them. She pointed me to the sprint website, where in the Terms and Conditions there is a line that says Sprint is NOT responsible for manufacturer's defects, which is news to me because the warranty that came with the phone says they ARE responsible, and must give me a new or FACTORY refurbished phone. We argued a bit more, and got nowhere, so I ask her why they are treating an almost 10 year customer like this. She says that I am lying again, because her screen shows I started my service in 2007. That is a complete lie, I know for a fact I started my service in August of 2002. I am really getting tired of sprint's lying and cheating and treatingn customers like this.

I asked to talk to her supervisor who is supposed to call me back tomorow, so I will let you all know how that goes.
