Was sold a used phone... Need some advise.

Take action immediately!

1. Have you called the Attorney General's office yet?

2. Have you posted this on Rip-Off report? Use full names of everyone you have talked to. It is not illegal to tell the truth.

3. Write a letter to Dan Hesse.

4. Call your local Consumer Reporter at your local news station. The ones in the Orlando area are sharks. They would eat this stuff up.

5. Contact one of those cheesy lawyers and see if they can sue for mental distress for that bitch calling you a liar!

So I went into the sprint store today to get a replacement phone that I was promised a while ago, but couldnt get because they were out of stock. The guy goes to the back and gets what looks to be a new phone. But I noticed there was red marker all over the UPC and esn stickers on the phone and on the box. Kind of wierd I thought, but everything looked new. When I left, I did a ##786# and found the phone was activated on 8-10, had over 1000 calls, and was NOT refurbished. So now I am in the same boat, Sprint gave me a USED phone.

Was this phone sealed?? The phone itself, in a plastic bag? file a complaint on bbb.org as well.
One of the best ways i believe to tell if a phone is new or not is to look for the seal....or can that seal be put on refurb phones as well? anyone?


A friend of mine was sold a used phone as well (had a bloody screen protector on it), but he noticed it while he was in the store....the store called him back the next day for a brand new one. Think of how many customers, that did get a used phone sold to them and dont even notice.

Wow dude, I thought my situation sucked... I hope you get it resolved easily and quickly.

I returned my original phone to the Sprint Store I bought it from on the 24th. They asked a couple questions, which I ignored. The guy I dealt with knew my situation, the guy that sold me the phone in the first place was there, and didn't even remember me.

Tomorrow I wake up and call CS again, and ask them to verify my payment schedule and contract date is adjusted to yesterday. Fingers crossed on that one. I might loose that battle...

Yes, and the BBB, which usually sprint will bend over backwards when they hear about it, but this time I got a call back from the same "executive supervisor" I was currently talking to. She actually told me not to contact them anymore, because it will actually hurt my case...

Hhmm, also if possible maybe record the conversations each of you are having? Or even better yet video record it to have some kind of proof.

I have been recording every call to sprint since about 2 months ago when they lied to me about a discount for renewing my contract. Unfortunately this has gotten me nowhere, because every time I tell them I can play back a recording when so and so said this, they say it doesnt matter.

I thought the phone was sealed, it was definetly in a new box. but when I got home I realized the charger and cord were not sealed, and the instruction manual was opened. Again, I have already contacted the BBB, but everytime I do, I get a call from this same executive lady, who is absolutely NO help at all.


So apparantly I have literally reached the top of the customer service ladder, and they wont give me what I want. I have been told MANY times by reps and supervisors to leave sprint, which I feel is just absolutely horrible service, especially when sprint should be fighting to keep every customer they have.

This is horrible what you guys have had to go through!! I had the evo for about 3 weeks when it forts came out. I ended up returning it because I was having soo many issues with it. Now I'm missing it, but with these stories I am scared to go back to Sprint. I do miss the everything data plan and price. I just dunno if its worth the hassle. I hope you all having this problem can get things figured out!

Sprint is great. Price is way better than other carriers. I have no idea why someone would let this go past 30 days. Somewhere you have to take responsibility for it all.

OP states he purchased a phone last week on 9.4 and if that is accurate (give or take a few days), he can return the phone with no questions asked.

You want to get their attention? Post the recordings on YouTube and let everyone hear how Sprint treats their customers. I bet you get a call from Sprint within a week offering you anything you want just to take down the recordings. Before you do it though, make sure recording phone calls is legal in your state.
