has anybody called sprint and questioned them why 10 extra if you cant get 4g?

Getting a company discount has noting to do with the Premium Data fee. You just happened to work for a company that Sprint gives employee discounts. Congrats anyway, though!
U didn't read my post thoroughly I see ;)

1st off, I know that the discount doesn't hav anything whatsoever to do with the premium...

2ndly, I don't & hav never worked for any company @all! I'm self-employed...

But thanks :)

The 10$ FEE has nothing to do with 4G.
What that 10$ FEE does is UNCAP your 5gb month 3G data.
The believe with these high end multimedia devices,
that we will use more data as they to feature WiFi Hotspot.
I have to agree with the. 10$ is 10$ and you no longer have a cap.

you are wrong. my plan clearly says unlimited data without the 10 dollar fee

You guys have to stop spreading false info, you are doing the same thing you are claiming the others of doing. The $10 fee does not uncap 3g, it is already unlimited, the cap is ONLY for data cards, not for phones. If you have a samsung moment you have unlimited 3g just like if you have an Evo or Epic. They just did not want to name it a 4g fee so they can market 4g as free, but all it really does is give one access to 4g if available.

The EVO and the EPIC can stream and upload 720p HD video, even on 3G. One also supports full Flash over 3G and the other will soon. That's such a drain on network bandwidth. This is mostly what the fee is for. These devices are really data hogs.

The $10 fee has nothing to do with 4G access.

Call them an ask. The 5gb cap is for anything device connected to their network. If they do not enforce it, oh well. But if it has a 3g radio it is capped at 5gb. If you pay the 10 dollar fee there is no cap. Dont believe me. Call them. People want to complain over 10 dollars, no wonder this country is in a ditch.

well they do have to pay for the 4g so they said it was for things it wasn't but it could be for something they didn't tell us

None of that legally matters. Even if it was a 4G fee masked as something else, challenging that would hold no merit in court because they never claimed that the fee was for 4G access when making the contractual agreement between Sprint and it's customer, so it doesn't fit the legal definition of deception in a contract.

Practically speaking data plans listed as unlimited, even with fine print 5GB caps, are unlimited. Going to have a hard time making an argument that it's a real cap if there's no systemic, longstanding practice of going after people with 5.anything for additional payment or cancellation.

Practically speaking, it also wouldn't make sense for Sprint to go after people who don't go more than 2x over the 5GB fine print because they're still paying customers and represent a very small % of customers with such high useage.

As for the $10, seriously. Regardless of what it was called or what it was for, Sprint has always said it's a required charge for 4G-compatible phones so even if they said it was because Sprint just wants an extra $10 so be it.

I would never have considered getting an Evo if I didn't think I'd have 4G access as a part of build out or when traveling. The other features are fine, but it's the 4G that makes these phones valuable to me. The speed makes a difference when I'm mobile. To that end, I'm glad the rollout is finally catching major metro areas now.

I am not challenging it at all, I just hate when i read that its because it has a big screen, it uses data, it has Android market place on it, and not to mention it can take pics. So we are going to charge an extra $10 only on the 4g phones only because the others couldn't do anything like that.

I do not mind the extra cost because i get an extra that not many phones have right now. I do want 4g in my town, but i can wait since it should be coming soon, I just don't like it when someone is trying to pull my chain and is telling me they are.

They're also the only widely commercially available devices that can video chat save the iPhone 4.
